Dear Mayor Chao, Vice Mayor Moore and Councilmembers, I would like to express my concern about how last week’s meeting concluded. The meeting ended abruptly when Councilmember Ray Wang disconnected, which halted the discussion and delayed action on Item 12. While he stated that the item was not properly agendized, the agenda clearly included the direction to “consider the Mary Avenue project and provide direction on next steps, including appointing the City Manager and Interim City Attorney as negotiators.” From my perspective, it appeared the discussion was on solid procedural footing. It seemed that the city attorney and Mayor Chao agreed as well and they clearly stated that to him. The sudden disconnection had the effect of stalling the entire item, even though the Council was actively engaged in discussion. This raises broader concerns about the use of remote attendance in noticed locations and the ability of a single councilmember to end a meeting. Until recently, this had not been an issue, and I hope the Council will consider steps to ensure that meetings can proceed without disruption. For these reasons, I respectfully request that the Council not appoint Councilmember Wang as Vice Mayor at the December 11 meeting. I believe it is important for all councilmembers to demonstrate consistent ethical conduct and respect for the Council’s collective work. I also ask that the Council reconsider allowing Councilmember Wang to attend meetings remotely, given the pattern of disruptions that have occurred. It is important that all members participate in a manner that supports the functioning of our city government. Finally, I request that the Mary Avenue Project be placed on the December 11 agenda. The discussion that began on December 2 should have been completed, and the community deserves clarity and forward progress on this important issue. Thank you for your consideration. It is my understanding you are planning to vote in a Mayor and Vice-Mayor for the upcoming year at the December 11, 2025 Special Meeting. I urge you not to vote-in Council Member Wang for either position. Doing so would be a mistake and a disservice to Cupertino’s residents. You will be rewarding the poor performance of Council Member Wang. One of the worst things an organization can do is to promote/reward poor performance. Why am I making this request? Council Member Wang violated multiple provisions of the City Code of Ethics in the City Council meeting of December 2, 2025. He threatened the City Attorney and City Council Members with retaliation if they did not accept his viewpoint, then followed through on that threat by disconnecting from his remote Zoom meeting attendance at that meeting, knowing it would require the City Council meeting to end abruptly, which is a violation of the City Code of Ethics for Cupertino Council Members. We cannot unsee what we saw or unhear what we heard. I have also become aware that Council Member Wang issued an “apology letter” to City Manager Kapoor and Mayor Chao dated December 8, which I have obtained a copy of. In that letter, he blames his computer battery as the reason he had to hang up from the Zoom meeting on December 2. Having watched the meeting video in the link multiple times, it is obvious his threat to end the meeting had nothing to do with his computer battery. Rather, it was an intentional act to disrupt the meeting. And instead of apologizing for his bad behavior, he is blaming his computer battery, meaning he is not being truthful, which is another ethical issue. After seeing and hearing Council Member Wang's behavior at the December 2 meeting, how can you almost immediately thereafter justify rewarding this behavior with a vote to promote/appoint him to Vice-Mayor or Mayor of our City? In addition, I also urge you to determine and implement whatever appropriate punitive actions the City Council should take to ensure Council Member Wang's unfortunate actions do not recur. Cupertino's residents deserve much better. I hope you can see the logic in my request. Councilmember Fruen, I am a Planning Commissioner for the City of Cupertino, writing as myself today. City Manager and City Clerk, please include this email in the public record for the December 11, 2025 council meeting. I was forwarded the email below that Councilmember Wang sent to his fellow Cupertino Council members. I am offended that Councilmember Ray Wang is telling us to "believe what I say now, not what I said during the Dec 2 council meeting or what you saw with your own eyes." The city residents are not fools. Councilmember Wang could have chosen to admit his wrongdoing and apologize sincerely. Instead, he decided to dig himself an even deeper hole by blatantly misrepresenting what occurred as if we didn't all witness his behavior in real time. Here's the link to the discussion during the council meeting. At timestamp 3:01:54, Councilmember Wang says "Well, at this point, then, I will have to leave the meeting. You do understand the ramifications?" He doesn't say "Oh sorry, my battery is dying". He does not appear frantic, he's actually quite calm. He makes a clear threat that everyone on the dais understands as a threat, as you can see from everyone's shocked faces. If Councilmember Wang's intention had been to "shut down my camera and leave in protest, NOT to end the meeting" as he now claims, there would have been no ramifications, the meeting would have continued unimpeded. So the very fact that he mentions ramifications means he was threatening to end the meeting. At timestamp 3:02:05, Councilmember Wang repeats "At this point, I will have to leave the meeting... and the meeting will conclude." He is again clearly threatening to leave the meeting and force the council meeting to end as a result. He knows and clearly states the implications of his actions in that the meeting will be forced to conclude if he hangs up. Again, he is calm, he is not in a hurry, he is not frantically trying to fix battery issues, he is staring right at the City Attorney as he is making his threat and then he waits to see what her response will be. At timestamp 3:02:11, Mayor Chao responds "Then we cannot vote on anything" indicating that she understands the threat made by Councilmember Wang will result in the meeting ending. Councilmember Wang responds by nodding his head in a manner indicating he understands the implication of Mayor Chao's statement and reiterates his assertion that the item cannot be voted upon because it is agendized as a study session. At timestamp 3:02:42, after Councilmember Fruen reminds him that two attorneys (The City Attorney and Councilmember Fruen who is an attorney) have confirmed that a vote on the agenda item is appropriate, Councilmember Wang retorts "Then I will leave the meeting". This is a clear case of retaliation because the City Attorney did not capitulate to his threat. At timestamp 3:02:47, Councilmember Fruen specifically says to Councilmember Wang "If you leave the meeting, you can leave the room open for the public to participate" so that the meeting can continue and Councilmember Wang responds "I cannot according to the Brown Act." which is a false assertion because the Brown Act specifically requires the exact opposite. It is clear from this exchange that Councilmember Wang is fully aware of what he's about to do and its consequences. At timestamp 3:03:27, Councilmember Wang calmly says "Ok, well, have a wonderful evening everybody and thank you." He then disconnects from the meeting. He is clearly not rushed and fully aware that he's ending the entire council meeting with his actions. Under California Penal Code Section 403 PC, it is illegal to disrupt a public meeting, defined as: The defendant intentionally committed acts that violated implicit customs or explicit rules for governing a public meeting The defendant knew or reasonably should have known that his or her acts violated those customs or rules AND the defendant's acts substantially and unlawfully interfered with the conduct of the meeting This is a misdemeanor offense “that may be punishable by up to six months in county jail, substantial court fines, fees and assessments, community service and/or labor requirements.” It seems quite clear that Councilmember Wang disrupted the December 2, 2025 council meeting, based on these criteria. Councilmember Wang has a long standing history of threatening people and blaming his computer for his behavior. In 2003, he denied sending pornographic images to Rosanne Foust, a former Redwood City planning commissioner and city councilmember, and claimed that "his computer was hacked". Councilmember Wang also served community service in 2004 due to the related criminal case in which he pleaded no contest to a misdemeanor charge of “making annoying telephone calls to a place of work”. According to a San Jose Spotlight article in July 2019, Councilmember Wang implied on the Nextdoor website in June 2019 that he would contact the employer of Richard Mehlinger, a pro-housing advocate and future Sunnyvale councilmember, who had been critical of him on Twitter. “Well that’s fun =) we’ll have to talk to Richard’s employer, DropBox. [sic] =)” The San Jose Spotlight article continues: "He also encouraged others in Cupertino who felt harassed by pro-growth activists known as YIMBYs...to “track down their employer and send their HR, Legal and CEO a letter outlining their YIMBY stance and all their tweets, their digital and social comms [sic] to show their lack of civility. It goes a long way to getting them reprimanded and in some cases a dose of reality.”" He then published an apology for his behavior in a letter to the Mercury News. It’s likely that Councilmember Wang may have apologized for his alleged sexual harassment of Rosanne Foust as part of his plea deal in 2004. And today he apologized for his many violations of the City Code of Ethics at the December 2, 2025 council meeting. So many apologies, yet it seems no real contrition. I urge you to reject this insincere apology and do the following: Do not appoint Councilmember Wang as Vice Mayor on December 11, 2025 Immediately revoke Councilmember Wang's remote participation privileges except in case of a documented emergency. Issue a public censure of Councilmember Wang for his many violations of the City Code of Ethics. Schedule a vote on the Mary Ave project at the Dec 11, 2025 council meeting to remediate the harm done to the applicants and the residents at the Dec 2, 2025 meeting. As our City Manager knows, while I was reminding everyone to add additional time, I was also suffering a battery issue and franticalliy trying to power my device. My intention that night was to shut down my camera and leave in protest, NOT to end the meeting. However, before I could do that, my battery died and I was not able to dial back in. By the time I was charged up to do so, the meeting had ended. I recognize that this action has created a lot of consternation and I accept the blame for this, though this was not my intention. Under California Penal Code Section 403 PC, it is illegal to disrupt a public meeting, defined as: The defendant intentionally committed acts that violated implicit customs or explicit rules for governing a public meeting The defendant knew or reasonably should have known that his or her acts violated those customs or rules AND the defendant's acts substantially and unlawfully interfered with the conduct of the meeting This is a misdemeanor offense “that may be punishable by up to six months in county jail, substantial court fines, fees and assessments, community service and/or labor requirements.” It seems quite clear that Councilmember Wang disrupted the December 2, 2025 council meeting, based on these criteria. According to a San Jose Spotlight article in July 2019, Councilmember Wang implied on the Nextdoor website in June 2019 that he would contact the employer of Richard Mehlinger, a pro-housing advocate and future Sunnyvale councilmember, who had been critical of him on Twitter. “Well that’s fun =) we’ll have to talk to Richard’s employer, DropBox. [sic] =)” The San Jose Spotlight article continues: "He also encouraged others in Cupertino who felt harassed by pro-growth activists known as YIMBYs...to “track down their employer and send their HR, Legal and CEO a letter outlining their YIMBY stance and all their tweets, their digital and social comms [sic] to show their lack of civility. It was recently brought to my attention that Councilperson Wang abruptly left a meeting of the City Council meeting that he was attending remotely. His sudden and abrupt absence resulted in the meeting having to end and left a key topic undecided. Listening to the recording of the meeting it appears that Councilperson Wang left the meeting specifically because he did not like the way the discussion was going. I do not believe this is the proper behavior for an elected representative. It shows a lack of respect for his colleagues, the City staff, the residents of Cupertino and the overall process of democracy. I understand that he offered a post meeting explanation that the real reason why he left so abruptly was that his computer was running out of power. He made no mention of this right before he left the meeting, so it seems to be a post facto explanation that does not hold up. I understand that Councilperson Wang has frequently attended meetings remotely while traveling for business. It has also been reported that he left other City Council meetings that he was attending remotely before the meetings were over. While I respect his willingness to serve on the City Council while keeping up his obviously very busy personal business career, I’m not sure that remotely attending as many meetings as he has is in the best interests of the residents of Cupertino. I am writing today as I understand the City Council is considering electing Councilperson Wang to the position of Deputy Mayor. I would strongly discourage the City Council from doing this. Councilperson Wang’s remote attendance record and his obvious disrespect for his colleagues, the City Staff and the residents of Cupertino, make him unqualified to serve as Vice Mayor this year. If Councilperson Wang would consistently attend City Council meetings in person and adopt a more cooperative and democratic attitude, he could be reconsidered for the position next year. No one wants the consequence of more Builders Remedy projects since they are not under local control!
