RESOLUTION NO. 2357
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING APPROVAL OF A USE PERMIT TO ALLOW
CONSTRUCTION OF APPROXIMATELY 700,000 S0. FT. OF
ADDITIONAL FLOOR SPACE AND MODIFY THE MASTER USE
PERMIT SITE PLAN FOR THE ENTIRE 96+ ACRE HEWLETT-
PACKARD SITE.

FINDINGS AND SUBCONCLUSIONS:
Approval is recommended subject to the findings as set forth on Page 1 and
subconclusions as set forth in the minutes of the Planning Commission meeting
of December 13, 1982.
CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, the special conditions enumerated herein shall apply.
15. Approval is based upon Exhibits A, B, C and D of Application 14-U-82.
The "area calculations" delineated on Exhibit A of Application 14-U-82
is approved. The 1,306,700 sq. ft. floor area figure defines the gross
floor area used for the calculation to achieve the maximum .31 Floor
Area Ratio imposed by the General Plan.
16. The building area delineated on Exhibit A of Application 14-U-82 may, at
the applicant's option, be constructed based upon the following schedule:
Building 44 Fall 1984
Cafeteria #3 Summer 1986
Building 45 Fall 1987
Building 46 Fall 1990
The applicant has the option to construct the buildings on an accelerated
schedule or to alter the building sequence.
The long-term phasing schedule does not preclude the City from imposing
new development and building standards and construction fees in con-
junction with building permit applications when said standards and
fees are applied on a broad basis to land uses of a similar type.
As a condition to this approval, the applicant or its successor shall
participate in street improvements required by the Construction Phasing
Memorandum for Vallco Park, as revised, which is a part of the Core
Area General Plan Amendment, adopted by City Council Resolution No. 3592.
The participation shall be in the form of a local improvement district,
or by direct participation if all affected property owners agree. The
applicant's share shall be determined in the manner prescribed by law
for a local improvement district and applicant's consent to such district
shall be irrevocable. The applicant shall enter into such a district upon
ninety (90) days advance notice by the City.

The improvements shall be in accordance with the Traffic Circulation
Element of the General Plan, as approved by City Council, including
improvements shown in Stages II and III of the Director of Public
Works memo dated July 15, 1974, as amended.
17. The applicant shall agree to participate in a future agreement, as required,
with the City to provide for work shift movements and considerations of
car pooling to alleviate traffic problems.
18. Modification of the Approved Development Plan or a Building Permit
In the event that the applicant or subsequent property owner shall desire
to make any minor change, alteration or amendment in the approved develop-
ment plan or building permit, a written request and revised development
plan or building permit shall be submitted to the Director of Planning
and Development. If the Director of Planning and Development makes a
finding that the changes are minor and do not affect the general
appearance of the area or the interests of owners of property within
or adjoining the development area, the Director of Planning and
Development may certify the change on the revised plan. If such
approval is withheld, the applicant may appeal to the Planning Commission.
If the changes are material, the Director of Planning and Development
shall submit the change to the Planning Commission for approval. If
the change is denied by the Planning Commission, the applicant may
appeal to the City Council as provided in Ordinance No. 652 of the
City of Cupertino. If the change is approved, an appeal may be made
by an interested party. Further, any member of the City Council may
request a hearing before the Council, said request to be made within.
ten (10) days from date of approval - when the change has been approved
by the Planning Commission.

the Planning Commission of the City of Cupertino, State of California, by the
following roll call vote:
