OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
APPROVING A MODIFICATION OF AN EXISTING USE PERMIT
TO ALLOW LIVE MUSIC IN A COCKTAIL LOUNGE (HEEDEE'S)

FINDINGS AND SUBCONCLUSIONS:
Approval is recommended subject to the findings as set forth on Page 1 and
subconclusions as set forth in the minutes of the Planning Commission meeting
of July 12, 1982.
CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, the special conditions enumerated herein shall apply.
15. The approval is based upon Exhibits A, A-1 and A-2 of Application
15-U-79 (Revised) which describes the general location of the 3,200
sq. ft., 92 seat capacity cocktail lounge as amended by additional
conditions contained herein. The use permit shall be reviewed upon
any proposed change of the Alcoholic Beverage Control (ABC) licensee.
16. Live music limited to two non -electrically amplified musical instruments
operated by no more than two persons is permitted subject to the noise
performance standard described in Condition No. 17. A dance floor is
not approved unless this use permit is further amended.
17. Sound from recorded or live music shall not penetrate beyond the property
line separating the commercial center from adjoining residential area.
The sound attenuation properties of the building and masonry sound barrier
shall be tested in the evening (midnight) prior to occupancy of the
cocktail lounge and compared to the live music condition. Appropriate
acoustical treatment must be installed if required to maintain the
original non -music sound level condition.
18. The applicant shall repair any major pavement deficiencies in the Portal
Plaza Shopping Center parking lot subject to the review and approval of
the Director of Public Works. Said repairs shall be completed to the
staff's satisfaction prior to issuance of building permits.
19. The masonry barrier separating the Portal Plaza site from adjoining
residences shall be raised in height at a minimum of 8 ft. measured
from both sides of the wall.
20. The existing vehicular barrier located at the east end of the service
alley shall be modified to prohibit the movement of bicycles and
motorcycles.

21. The applicant/property owner shall install trash enclosures to house the
trash bins on the shopping center site. The location of the trash
enclosures shall be subject to staff approval.
PASSED AND ADOPTED this 12th day of July, 1982, at a regular meeting of the
Planning Commission of the City of Cupertino, State of California, by the
following roll call vote:
