HomeMy WebLinkAboutReso 2324RESOLUTION NO. 2324 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF A USE PERMIT TO OPERATE A TAKE-OUT DOUGHNUT SHOP WITHIN AN EXISTING BUILDING. APPLICANT: James H. Asher ADDRESS: 10100 Adrianna Avenue, Cupertino, California 95014 SUBMITTED: June 14, 1982 LOCATION: Southeast corner of Stevens Creek Boulevard and Imperial Avenue (10010 Imperial Avenue) within the Monta Vista neighborhood commercial area. FINDINGS AND SUBCONCLUSIONS: Approval is recommended subject to the findings as set forth on Page 1 and subconclusions as set forth in the minutes of the Planning Commission meeting of July 12, 1982 CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions enumerated herein shall apply. 15. That the approval is based upon Exhibit A of Application 8-U-82 as may be amended by additional conditions contained herein. 16. The applicant/property owner shall be required to install Imperial Avenue road improvements consistent with the Monta Vista Street Improvement Plan. 17. The applicant is required to file a tentative map to consolidate the subject property with the 25 ft. wide parcel under the same ownership to the south. The applicant shall improve said southerly portion with parking consistent with the City of Cupertino Parking Ordinance and Parking Standard Details subject to the approval of the staff. The final map shall be approved by the City Council and parking improvements scheduled to be installed prior to installation of the doughnut shop facility. 18. The applicant shall comply with all requirements of the building code including the provision of bathroom facilities per the requirement of the Santa Clara County Environmental Health Services Department and the Bakery Sanitation Act. 19. In conjunction with the tentative map for the consolidation of the two parcels the applicant shall enter into reciprocal ingress/egress easements with the United Cable Television office building located to the south of the 25 ft. wide parcel described above. 20. The applicant shall submit a plan for landscaping and/or paving material improvements along the Imperial Avenue and Stevens Creek Boulevard frontage to the Architectural and Site Approval Committee. Said plans shall reflect the eventual right of way and street improvement to be implemented along Imperial Avenue. Landscaping and paving improvements shall be installed prior to commencement of the doughnut shop operation. -2- 8-U-82 Resolution No. 2324 (continued) 21. Hours of operation shall be limited to 6 a.m. to 11 p.m. The facility may be permitted up to 24 seats. 22. The property owner shall record a deferred agreement obligating existing and future property owners to comply with Condition Numbers'16, 17, 19 and 20 within two years of this approval.
