RESOLUTION NO. 2322
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
APPROVING A USE PERMIT AMENDMENT TO ALLOW GENERAL
OFFICE AND COMMERCIAL USES IN A CONVERTED RESIDENCE.

LOCATION: South side of Stevens Creek Boulevard approximately 270 ft. east
of Stelling Road
FINDINGS AND SUBCONCLUSIONS:
Approval is subject to the findings as set forth on Page 1 and subconclusions
as set forth in the minutes of the Planning Commission meeting of July 12, 1982.
CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, the special conditions as enumerated herein shall apply.
15. The approval is based upon Exhibit A of Application 1-U-68 (Revised)
and the letters from the applicant dated June 2, 1982 and May 19, 1982
as may be amended by additional conditions contained herein.
16. The applicant shall improve the parking lot (pave with asphalt concrete)
to comply with the standards of the Department of Public Works and the
back-up and stall width requirements of the Cupertino Parking Ordinance.
Additionally, the landscape area shall be widened to a minimum of 5 ft.
and landscaped with shrubs to screen the parking lot, subject to staff
approval.
17. The applicant shall dedicate the westerly 45 ft. of the property as a
public street.
18. The applicant shall record a covenant obligating existing and future
property owners to enter into reciprocal ingress/egress easements at
such time in the future as the City can require the same of the adjoining
property owner. The covenant shall be recorded at no cost to the City.
19. The use permit is granted to allow general commercial, general office and
retail commercial uses normally allowed within the CG Zoning Ordinance of
the City of Cupertino without the requirement of obtaining a use permit.
Uses requiring a use permit in a CG zone will also require use permit
revision. Additionally, restaurants and markets shall also require
revision of this use permit.

2O. Upon redevelopment of the subject property, the applicant/property owner
shall agree to improve the property frontage on the future public street
area referenced as Bianchi Way. If said street has been improved by a
preceding development of the property(ies) to the south, then the
applicant/property owner shall reimburse those persons for improvement
of the applicant's frontage along said street.

Planning Commission of the City of Cupertino, State of California, by the
following roll call vote:
