RESOLUTION NO. 2304
OF THE PLANNING COMMISSION
RECOMMENDING DENIAL OF A USE
PERMIT TO ALLOW BEER/WINE SALES
WITHIN AN EXISTING SERVICE STATION.

LOCATION: Southeast corner of Stevens Creek Boulevard and Foothill Boulevard.

FINDINGS :
1. The proposed use is incompatible with gasoline sales.
2. It will be difficult to control sales of beer and wine to minors.
3. There, is greater possibility of consumption of beer and wine on the premises or
within motor vehicles.
4. There is presently a proliferation of establishments with alcoholic beverage
sales within the area.
5. The subject site is contiguous to an existing residential area.
6. The site is along the route to a recreational area.
7. There are existing problems of neighborhood disturbances due to drinking,
loitering, prowlers, etc. as documented by testimony of the adjoining resident:;
which make the introduction of a new beer/wine sales facility inadvisable.
PASSED AND ADOPTED this 10th day of May, 1982, at a regular meeting of the Planning
Commission of the City of Cupertino, State of California, by the following roll call
vote:
