It is the stated purpose of this Confidential Compensation Program to give recognition to and to differentiate those eligible employees fr"om represented employees who achieve economic gain and other conditions of employment through negotiation. It is the intent that through this policy and those which are adopted or as may be modified or rescinded from time to time such recognition may be given. As rates of pay and schedules of pay grades developed through meet and confer processes are subject to the underlying provisions of the Pay Plan for administration purposes so are those rates of pay and schedule of pay grades included herein as a part of this Confidential Compensation Program. The inclusion herein of said rates and schedules does not affect any effective dates or otherwise reflect on the approval processes required but is shown as an integral part of this Program for completeness of record. Adopted by Action of the City Council June 23, 1980 -3- City of Cupertino CONFIDENTIAL COMPENSATION PROGRAM Policy No.3 AUTOMOBILE ALLOWANCES AND MILEAGE REIMBURSEMENTS It is City of Cupertino policy that eligible persons under the Confidential Compensation Program shall be compensated fairly for the use of personal automotive vehicles on City business. In some instances the use of personal vehicles is a condition of employment when there may be an absence of sufficient City vehicles for general transportation purposes. It is not intended, however, that such a condition of employment should work an undue hardship. For this reason the following policies shall apply for- automobile allowances and mileage reimbursements. Those persons who occasionally are req~ired to use their personal automobiles for City business shall be reimbursed for such use at an appropriate rate established by the City Council. Submission of a reimbursement request must be approved by the Department Head. While recognition is given that similar or modified automobile allowance and mileage reimbursement schedules may be applicable to employees not eligible under the Confidential Compensation Program, its inclusion as a policy under said Program is for completeness of record. Adopted by Action of the City Council June 23, 1980 Revised July, 1987 -4- City of Cupe~tino CONFIDENTIAL COMPENSATION PROGRAM F'olicy No.4 COMPENSATORY TIME OFF It is City of Cupe~tino policy that eligible pe~sons unde~ the Confidential Compensation P~og~am shall be entitled to compensato~y time off in like amount fo~ such time wo~ked in excess of what othe~wise might be conside~ed as a no~mal wo~k day 01" wo~k week fo~ othe~ employees. Such "ove~time" wo~~:ed o~ compensato~y time taken off shall not be ~eco~ded fo~ attendance o~ pay~oll pu~poses. Individuals occupying confidential positions a~e employed to pe~fo~m specific functions. In many cases the fulfillment of a given function ~equi~es effo~t without ~ega~d to ~egula~ wo~king hou~s. Often these additional ~equi~ements a~e cyclical and p~ovide late~ oppo~tunities fo~ some ~elief f~om the extended wo~k effo~ts. At such times when it is possible to do so, it is expected that the affected pe~son and his supe~ivso~ mutually will ag~ee as to when compensato~y time off will be taken. It is the stated pu~pose of this policy to p~ovide some pe~iods of time fo~ eligible employees to ~elax and become disassociated f~om the st~esses of wo~k and, in pa~t, to offe~ ~ecognition fo~ the demands of ~equi~ed but un~eco~ded lIover-timell . Adopted by Action of the City Council ,June 23, 1980 -5- City of Cupe~tino CONFIDENTIAL COMPENSATION PROGRAM Policy No.5 HEALTH BENEFIT PLANS - EMPLOYER CONTRIBUTION It is the policy of the City of Cupe~tino to p~ovide ~~oup hospital and medical insu~ance unde~ which employees in Confidential positions and thei~ dependents may be cove~ed. The pu~pose of this p~og~am is to p~omote and p~ese~ve the health of employees and thei~ families th~ough comp~ehensive health plans available only th~o~gh employe~ sponso~ship. Although the p~emium cost fo~ the insu~ance p~ovided ~emains the ultimate ~esponsibility of the employee in a Confidential position, the City shall cont~ibute an amount of $200.00 pe~ employee pe~ month towa~ds the p~emium o~ pay the full cost of the p~emium if less than this amount. If p~emium amounts fo~ any employee cove~ed by this policy a~e less than $200.00 pe~ month, the diffe~ence between the p~emium amount and $200.00 will be cont~ibuted by the City to a defe~~ed compensation account in the employee's name in acco~dance with Policy No.8 of this plan and the ~egulations of the compenstion defe~ment p~og~am of the City. Adopted by Action of the City Council June 23, 1980 Revised June, Revised June, Revised July, Revised July, 1981 1982 1983 1987 -6- City of Cupertino CONFIDENTIAL COMPENSATION PROGRAM Policy No.6 FLEXIBLE HOLIDAYS It is the policy of the City of Cupertino to recognize days of historical and national significance as holidays of the City without loss of payor benefits. Recognizing the desirable continuance of municipal services by confidential employees resulting from scheduling of occasional holidays at variable times throughout the year, it is the policy of the City of Cupertino to provide days off in lieu of holidays for confidential employees at such times as are convenient for each employee and supervisor, when such policy is compatible with the workload and schedule of the City. Employees occupying confidential positions shall be provided two days per calendar year as a non-work day with full pay and benefits in addition to those holidays set forth in Section 8.1 of the Rules on Conditions of Employment. For payroll purposes, each such in-lieu-of day off shall be recorded as a holiday. Adopted by Action of the City Council June 23, 1980 -7- City of Cupe~tino CONFIDENTIAL COMPENSATION PROGRAM Policy No.7 LIFE AND LONG-TERM DISABILITY INSURANCE It is the policy of the City of Cupe~tino to make available group insu~ance fo~ Confidential employees that will mitigate the pe~sonal and family financial ha~dships ~esulting f~om continuing disability that p~events an employee from pe~fo~ming gainfully in his o~ he~ occupation. It is fu~the~ the policy of the City of Cupe~tino to p~ovlde life insu~ance benefits five times the emplayee~s annual salary to a maximum of $250,000.00 for confidential employees. Employees occupying Confidential positions may en~oll in the disability income p~og~am and the life insu~ance p~og~am offe~ed if eligible unde~ the cont~act p~ovisions of the policy and the pe~sonnel ~ules of the City. The full cost of p~emiums fo~ these insu~ances shall be paid by the City fo~ such employees. Adopted by Action of the City Council June 23, 1980 Revised June, 1982 -8- City of Cupertino CONFIDENTIAL COMPENSATION PROGRAM Policy No. B DEFERRED COMPENSATION It is the policy of the City of Cupertino to provide equitable current compensation and reasonable retirement security for confidential employees for services performed for the City. The City participates in State and Federal retirement systems and deferred compensation plans have been established. Both the employee and employer may make contributions from current earnings to these" plans. The purpose of this policy is to promote means by which compensation may be provided in such manner and form to best meet the requirements of the City and the needs of individual employees, thereby increasing the ability to attract and retain competent confidential employees. The City shall maintain and administer means by which employees in confidential positions may defer portions of their current earnings for future utilization. Usage of such plans shall be subject to such agreements, rules and procedures as are necessary to properly administer each plan. Employee contributions to such plans may be made in such amounts as felt proper and necessary to the employee. Employer contributions shall be made pursuant to Confidential Compensation Plan policies numbers 5 or B, or in such other form as determined desirable and proper by the City Council. Adopted by Action of the City Council June 23, 1980 Revised July, 19B7 -9- City of Cupertino CONFIDENTIAL COMPENSATION PROGRAM Policy No.9 PUBLIC EMPLOYEES RETIREMENT SYSTEM CONTRIBUTION It is the policy of the City of Cupertino to pay the eligible employee's contribution I"ate to the Public Employees' Retirement Sy$tem not to e>:ceed seven percent (7%) of the applicable salary. Adopted by Action of the City Council June 23, 1980 Revised June, 1981 Revised July, 1987 -10- City of Cupertino CONFIDENTIAL COMPENSATION PROGRAM Policy No. 10 DENTAL INSURANCE - EMPLOYER CONTRIBUTION It is the policy of the City of Cupertino to provide dental insurance under which employees in Confidential positions and their dependents may be covered. The purpose of this program is to promote and preserve the health of employees. The premium cost for the insurance provided by the City shall not exceed $35.50 per month per employee. Enrollment in the plan or plans made available pursuant to this policy shall be in accordance with Personnel Rules of the City and the provisions of the contract for such insurance between the City and carrier or car-riers. REBATE The City agrees to pay the Confidential Unit Employees covered by this agreement ê~§Z% of their base salary to reflect the reduced PERS rate for fiscal year ~87!88. Payment will be made December 15, 1987 for the base pay earned from June 24, 1987 to December 8, 1987. A second payment will be made June 30, 1988 for the base pay earned from December 9, 1987 to June 21, 1988.
