RESOLUTION NO. 2289
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING APPROVAL OF A USE PERMIT TO CONSTRUCT
AN OFFICE BUILDING EQUALING 91,000 SQ. FT.

LOCATION: North side of Rodrigues Avenue from De Anza Boulevard to a point
approximately 400 ft. easterly of Torre Avenue
FINDINGS AND SUBCONCLUSIONS:
Approval is recommended subject to the findings as set forth on Page 1 and
subconclusions as set forth in the minutes of the Planning Commission meeting
of March 8, 1982.
CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, the special conditions enumerated herein shall apply.
15. The approval is based upon Exhibits A 1st Revision, B 1st Revision and
B-3 of Application 7-U-81 as may be amended by additional conditions
contained herein.
16. The applicant/property owner agrees to participate in his proportionate
share of major off -site street improvements of a local or communitywide
nature, such as major improvements to the intersection of De Anza
Boulevard and Stevens Creek Boulevard. Said agreement shall include,
but not be limited to, agreement to participate in a local improvement
district, or directly contribute to street improvements. If an assess-
ment district is formed, the applicant/property owner's share would be
determined by a cost benefit ratio as established by assessment district
law. Boundaries for any district would be determined at a later date
per assessment district law.
17. Torre Avenue shall be extended from its present terminus near Rodrigues
Avenue to Stevens Creek Boulevard to align with Vista Drive. Torre
Avenue shall be designed to a standard to be approved by the Director
of Public Works. The road alignment may require a slight shift from the
present configuration through the subject property. The applicant/
property owner shall be responsible for dedication of right of way
and installation of improvements along his/her property frontage to
accommodate this shift if required.
The agreements to install the above improvements shall be submitted
and recorded prior to or in conjunction with the issuance of
building permits.

18. The approval is to construct an office building equaling 91,000 sq. ft.
of gross floor area. Gross floor area shall be inclusive of all
perimeter walls and interior walkways, etc.
19. The applicant shall record a covenant entering into a reciprocal
ingress/egress easement with all property owners within the Town
Center Planning Area. The applicant shall consolidate driveways
with the Northern California Savings and Loan site so that there
is no more than one driveway off of De Anza Boulevard. The easterly
most driveway off of Rodrigues Avenue shall align with the driveway
located to the south of Rodrigues Avenue serving the existing office
buildings. It is recognized that the reciprocal ingress/egress
arrangements will delete parking spaces which shall be added to
the present parking lots so that there is no less than one space
for every 285 sq.ft. of gross floor area.
20. The applicant shall prepare a landscape and sidewalk plan in conjunction
with the property owners of the remaining undeveloped properties within
the Town Center area and their designers. Said plans shall incorporate
a sidewalk landscape theme and include design elements for corner plazas
and textured paving treatment to be utilized at street intersections.
Said plans shall be submitted to the Architectural and Site Approval
Committee for informal review and then to the Planning Commission and
City Council for adoption prior to installation of the landscaping and
sidewalk improvements on the subject site. The parking lot located on
the west side of .Torre Avenue shall be similarly treated with landscaping,
landscape screening improvements and improved with public sidewalks per
the theme to be developed by the property owners and applicants.
21. Under the present General Plan, the applicant understands that the remaining
three acres undeveloped on the northeast corner of Rodrigues Avenue and
Torre Avenue is permitted to develop in residential uses only up to a
maximum of 42 dwelling units.
22. Building height shall not exceed 45 ft.
23. The applicant shall strive to implement Alternative Site Plan Exhibit
A 2nd Revision. The Director of Planning and Development is authorized to
approve a final design of said alternative site plan.

Planning Commission of the City of Cupertino, State of California, by the
following roll call vote:
