Re: Tennis Court Lighting Upgrade Project
Dear Mr. Hirshfield:
This refers to your letter to City Council dated ]March 6, 2009 on the above subject.
The construction of the Tennis Court Lighting ~:Ipgrade project, as you know, is underway
with Cupertino Electric. It is expected to be completed on time and within budget by mid
July 2009. The work currently underway involves increasing the illumination of the existing
lights and adding some additional poles to evert out the distribution of light on a total of 12
courts. These courts have had lights since the origin of the Sports Center in the mid 70s.
In your letter you suggested that the Council hard earlier approved a project to not only
improve the lighting on the 12 courts that have lights now, but to also add lights to 5 courts
which never had lights. We cannot find any re~~ord to indicate that, whatever you recall
being discussed, the Council approved any project or budget to improve the lights beyond
the upgrading of the existing lights on the 12 courts.
With respect to adding lights to the 5 courts than are currently unlit, it would not be possible
to do by contract change order because a number of actions would have to be undertaken
before any work could begin. First and foremost the work would require a separate
environmental review covered by the California Environmental Quality Act (CEQA), which
as you correctly point out will allow time for comments and input from the residents of the
Commons.
Of course, since this would be a new project, Council approval of a project scope and budget
would precede the environmental review and that project is not a part of the current CIP nor
is it contemplated for the upcoming fiscal year of 09/1 O.
Finally, because of the extreme financial duress under which the City is trying to balance its
budget in this very bad and worsening economic climate, we do not see the additional
lighting as a high priority now or anywhere in the near future.
For all those reasons, we cannot proceed with your suggestion and by copy of this letter will
so advise the City Manager and the City Council.
