HomeMy WebLinkAboutReso 245927 -U --Si (Revised) RESOLUTION NO. 2459 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL FOR AN AMENDMENT OF A PREVIOUSLY APPROVED USE PERMIT TO CONSTRUCT A TWO-STORY OFFICE BUILDING EQUALING APPROXIMATELY 10,620► SO. FT. APPLICANT: William A. K:i nst ADDRESS: 2224F Old Middlefield Way, Mountain View, California 94043 SUBMITTED: October 3, 19.83 LOCATION: West side of Pasadena Avenue approximately 150 ft. south of Stevens Creek Boulevard FINDINGS AND SUBCONCLUSIONS: ONS Approval is recommended subject to the findings as set forth on Page 1 and subconclusione as set forth in the minutes of the Planning Commission meeting of November 14, 1983. CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions as enumerated herein shall apply. 15. That the approval is based upon Exhibits A, A -I and B of Application 27-U-81 (Revised) as may be amended by additional conditions contained herein. The approval is granted to allow construction of an office/commercial building equalling 10 620 sq. -ft. of gross floor area. 17. Allowed uses shall include all those uses permitted as a matter of right within the City of Cupertino General Commercial (CS) Zoning Ordinance. Uses requiring a Use Permit in a CG zone shall also require modification of this Use Permit. 18. The applicant shall agree to join a Monta Vista commercial area maintenance and lighting district. 19. The applicant shall return to the Architectural and Site Approval Committee for approval of plans detailing building design and colors, on -site landscaping, lighting, fencing, and signing . consistent with the requirements of the Monta Vista Design Guidelines. Additionally, the public sidewalk shall be shifted on -site under the building over gig. The applicant shall record the appropriate pedestrian walkway easement over the sidewalk area. 1 Resolution No. 2459 (continued) 27-PU-S i (Revised) 20. As part of the street improvement requirements, the applicant shall agree to install a central commons landscape area located between two cul-de-sacs on Pasadena Avenue. A central commons option is being evaluated in conjunction with the General P=an Amendment which may not be resolved prior to commencement of construction subject building. Accordingly, the cPr3�tr:_;c __ of the subject � app l i cant c ` s -ommi tment may be deferred until the issue of r - closure of Pasadena Avenue is resolved. The applicant shall only be responsible for improvements equivalent to a half -street area along the frontage of the subject property. The applicant shall also be responsible for design of the central commons landscape area which shall be reviewed by the Architectural and Site Approval Committee, Planning Commission and City Council 21. The applicant shall record a covenant agreeing to provide reciprocal ingress/egress easements with the adjoining properties at such time in the future as City can require the same of the adjoining property owners. The applicant shall have the option of shifting the northerly driveway to the common property line with the property to the north. Additionally, the applicant shall designate the southerly drive as a one-way out only pending redevelopment of the property to the south. 22. The Architectural materials approved include horizontal wood siding painted in muted colors and asphalt roof -shingles consistent with the Monta Vista Design Guidelines. 23. The applicant shall retain and provide tree protection details for the existing Pepper tree located at the westerly property line. The other Pepper tree located near the northerly property line may be retained, if feasible, subject to review by staff at the building permit level. The applicant shall incorporate tree grates and root shields for the street trees consistent with the requirements of the tionta Vista Design Guidelines. Additionally, benches shall be located in the central commons area if the Pasadena Avenue street closure is approved. 24-. This Use Permit revision shall be implemented (i.e. commence construction) within one year of the date of City Council approval.
