HomeMy WebLinkAboutReso 2458_2-U-83 RESOLUTION NO. 2458 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF A USE PERMIT TO CONSTRUCT A SINGLE-FAMILY HOME IN A PLANNED DEVELOPMENT ZONE. APPLICANT: Virgil E. Ellsworth ADDRESS: 10185 Pasadena Avenue, Cupertino California 95014 SUBMITTED: September 21, 1983 LOCATION: Westerly of and adjacent to Santa Clara Avenue approximately 50 feet south of the intersection of Santa Clara and Grand Avenues. FINDINGS AND SUBCONCLUSIONS: ONS Approval is subject subconclusions as Commission Meeting CONDITIONS: to the findings as set forth on Page 1 and set forth in the minutes of the Planning of November 14, 1983. 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions as enumerated herein shall apply. 15. Approval is based upon Exhibit A 1st Revision of Application 32-U-83 with the front yard setback on Exhibit A to be increased to 20 feet from the future property line. 16. The applicant shall install plumbing chases to facilitate the installation of future solar systems. The installation of said system is optional. 17. Modification of _tf; __ pro_v_ed__I3eve1 ©pmer�t___Pl an__gL__a ----------------- Eiui 1 d i ng_fiermi t In the event that the applicant or subsequent property owner shall desire to make any minor change, alteration or amendment in the approved development plan or building permit, a written request and revised development plan or building permit shall be submitted to the Director of Planning and Development. If the Director of Planning and Development makes a finding that the changes are i Planning Commission Resolution No. 2458 (continued) 32-U-83 minor and do not affect the general appearance of the area or the interests of owners of property within or adjoining the development area, the Director of Planning and Development may certify the change on the revised plan. If such approval is withheld, the applicant may appeal to the Planning Commission. If the changes are material, the Director of Planning and Development shall submit the change to the Planning Commission for approval. If the change is denied by the Planning Commission, the applicant may appeal to the City Council as provided in Ordinance No. 652 of the City of Cupertino. If the change is approved, an appeal may be made by an interested party. Further, any member of the City Council may request a hearing before the Council, said request to be made within ten (10) days from date of approval - when the change has been approved by the Planning Commission. 15. A sectional roll -up garage door shall be installed.
