HomeMy WebLinkAboutReso 245535-U-83 RESOLUTION NO. 2455 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF A USE PERMIT FOR 2 -PHASE REMODEL/EXPANSION OF AN EXISTING RESIDENTIAL DUPLEX. APPLICANT: Leo and Helen Bianchi ADDRESS: 10061 Bianchi Way, "A&B", Cupertino, 95014 SUBMITTED: November 25, 1983 LOCATION: West side of Bianchi Way, approximately south of Stevens Creek Boulevard. --------------------------------------------------------- FINDINGS AND SUBCONCLUSIONS: California 225 ft. Approval is subject to the findings as set forth on Page 1 and subconclusions as set forth in the minutes of the Planning Commission meeting of December 12, 1983. CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions as enumerated herein shall apply. 15. The approval is based upon Exhibits A and B of Application 35-U-83 as may be amended by additional conditions contained herein. 16. Use Limitations The subject Use Permit authorizes the expansion and occupancy of a duplex residential dwelling according to the following Phasing schedule: 1) Phase 1: - Construct detached 2 car garage, approximately 650 sq. ft. - Convert existing attached garage to interior living space. - Convert existing flat roof to sloped roof on duplex structure. - Add an uncovered parking space. The location and design shall be approved by staff in conjunction with a subsequent building permit. 2) Phase 2: - Construct additional interior living space of approximately 830 sq. ft. - Abandon septic tank system and connect project to sanitary sewer facilities. -1- RESOLUTION NO. 2455 (continued) 35-U-83 17. The proposed future addition at the westerly end of the existing duplex shall not be constructed until the site is connected to sanitary sewer facilities at which time the existing septic system and drain field shall be removed. 18. The site plan shall be modified at the building permit stage to reflect compliance with the following: - Consistency with all setback requirements of the R2 zoning district (Ordinance No. 575). - Depiction of all required street improvements. - Construction of a sloped roof element for the existing duplex structure as part of the first phase improvement. 19. Modification__ of__the__Aperov_ed__Dev_elopment__Plan__or___a Building_Permit In the event that the applicant or subsequent property owner shall desire to make any minor changes, alteration or amendment in the approved development plan or building permit, a written request and revised development or building permit shall be submitted to the Director of Planning and Development. If the Director of Planning and Development makes a finding that the changes are minor and do not affect the general appearance of the area or the interests of owners of property within or adjoining the development area, the Director of Planning and Development may certify the change on the revised plan. If such approval is withheld, the applicant may appeal to the Planning Commission. If the changes are material, the Director of Planning and Development shall submit the change to the Planning Commission for approval. If the change is denied by the Planning Commission, the applicant may appeal to the City Council as provided in Ordinance No. 652 of the City of Cupertino. If the change is approved, an appeal may be made by an interested party. Further, any member of the City Council may request a hearing before the City Council, said request to be made within ten (10) days from date of approval - when the change has been approved by the Planning Commission. 2D. Solar Facilities The applicant/builder shall install plumbing chases to accommodate future installation of solar collector equipment. Installation of the solar equipment proper is optional.
