APPLICANT: Creegan & D'Angelo (Pinn Brothers) ADDRESS: 39791 Paseo Padre Parkway, Fremont, CA 94538 SUBMITTED: September 16, 1983 LOCATION: Northeast quadrant of Rodrigues Avenue and Torre Avenue ------------------------------------------------------------------ FINDINGS AND SUBCONCLUSIONS: Approval is subject to the findings as set forth on Page 1 and subconclusions as set forth in the minutes of the Planning Commission meeting of October 10, 1983. CONDITIONS: Standard Conditions 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions as enumerated herein shall apply. Exhibits 15. The approval is based upon Exhibit A of Application 18 -TM -83 as may be amended by additional conditions contained herein. Density_Ronus_and_8MR_Obligatio_n 16. The applicant shall participate in the Below Market Rate Housing Program as described in the General Plan Housing Element and BMR Manual. Parkin3_Easement 17. The applicant/property owner agrees to participate in his proportionate share of major off -site improvements of a local or communitywide nature as identified in the General Plan. The applicant shall participate in the installation of brick paving treatment across Rodrigues Avenue at the intersection of Torre and Rodrigues Avenues to match the brick treatment at the City Hall/Library complex, and shall agree to share in half of the cost of brick paving treatment across Torre Avenue to connect with the Lincoln Properties site to the west. The textured pavement treatment may extend into an extended sidewalk area within the "curb return" area of the intersection. The extended sidewalk area refers to an area five feet in depth parallel to the property line and extending to each curb return. The applicant shall reserve the aforementioned easement area for future dedication. Private Streets 21. All applicable subsections of Sections 13.5 and 13.6 of the RIC Ordinance (Ordinance No. 664) regarding street improvement requirements and covenants shall apply to the subject development.
