RESOLUTION NO. 2449
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
APPROVING A USE PERMIT TO ALLOW INDIVIDUAL TENANTS
WITHIN A 7,500 SGT. FT. COMMERCIAL BUILDING

LOCATION: Southeast quadrant of Homestead and Stelling Roads

FINDINGS AND SUBCONCLUSIONS:
Approval is subject to the findings set forth on Page 1 and
subconclusions as set forth in the minutes of the Planning
Commission meeting of October 10, 1983.
CONDITIONS OF APPROVAL:
1-14. Standard Conditions to the extent that they do not
conflict with the special conditions enumerated herein.
In the event a conflict does exist, the special conditions
enumerated herein shall apply.
15. That the approval
is based upon Exhibits A, B, C 1st
Revision and Informational of Application 31-U-83 as may
be modified by additional conditions contained herein.
16. The allowable uses
authorized under this application are
as follows:
- Ice Cream Store
Approximately 1250 sq. ft. floor
area with 24 seats.
- Delicatessen
Approximately 1250 sq. ft. floor
area with 24 seats.
- Dry Cleaning Store
Approximately 1250 sq. ft. floor
area.
- Donut Shop
Approximately 1250 sq ft. floor
area with 36 seats.
- Restaurant
Approximately 2500 sq. ft. floor
area, maximum 120 seats.
General office uses such as Real Estate or Insurance are
determined to be inconsistent with the
Recreation/Entertainment intent of the complex and are not
approved. A Travel Agency is an acceptable use.

17. The subject Use Permit is conditioned upon the continued
viability of the Reciprocal Parking Agreement recorded in
the records of Santa Clara County, June 16, 1975,
#5030702. Should said agreement be revoked, cancelled or
declared void for any reason, the Use Permit may be
subject to review and amendment.
18. All conditions specified in Planning Commission Resolution
No. 2082 shall remain in full force and effect.

PASSED AND ADOPTED this 10th day of October, 1983, at a regular
meeting of the Planning Commission of the City of Cupertino, State
of California, by the following roll call vote:
AYES: Commissioners Claudy, Koenitzer, Szabo, Chairman Adams
NAYS: None
ABSTAIN: None
ABSENT: Commissioner Blaine
