RECOMMENDING DENIAL OF A VARIANCE FROM SECTION 8.3
OF ORDINANCE NO. 991 (R1 ZONE) TO ALLOW REDUCTION OF
A REQUIRED SIDEYARD SETBACK: FOR A TWO-STORY ELEMENT
FROM TEN (10) FEET TO SEVEN AND ONE-HALF (7.5) FEET.

FINDINGS:
1. That there are no exceptional circumstances applying to
the land, use and building referred to in the application
which do not apply generally to land, buildings or uses
in the same district.
2. That granting of the application is not necessary for the
preservation and enjoyment of substantial property rights
of the petitioner.

adjourned meeting of the Planning Commission of the City of
Cupertino, State of California, by the following roll call vote:
