HomeMy WebLinkAboutReso 2399ll-U-82 (Revised) RESOLUTION NO. 2399 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF A USE PERMIT REVISION TO MODIFY THE SITE PLAN FOR A 27 -UNIT RESIDENTIAL DEVELOPMENT FOR HANDICAPPED INDIVIDUALS. APPLICANT: Community Housing Developers, Inc. ADDRESS: 277 West Hedding Street, Suite 119, San Jose, California 95110 SUBMITTED: April 25, 1983 LOCATION: Approximately 150 ft. south of Stevens Creek Boulevard and 280 ft. east of Stelling Road. --------------------------------------------------------------------------------------- FINDINGS AND SUBCONCLUSIONS: Approval is recommended subject to the findings as set forth on Page 1 and subconclusions as set foxth in the minutes of the Planning Commission meeting of May 25, 1983. CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions enumerated herein shall apply. 15. The approval is based upon Exhibits A 1st Revision, B and (2) Informational as may be amended by additional conditions contained herein. 16. Approval is for a 27 -unit rental development for physically limited persons of low or moderate income. Any modification of this specific use or tenancy requirement shall require review of application or a new use permit. 17. The applicant/developer shall obtain dedication for street purposes and fully improve Bianchi Way to public street standards (including a public sidewalk) from the project site to Stevens Creek Boulevard. 18. The existing chain link fence adjacent to the Faria Elementary School site may be retained. This will provide the new development with a view of the open space on the school grounds. Plants (vines) may be installed for privacy. 19. Prior to issuance of a building permit, the applicant shall submit a parking and occupant safety plan to the City Council for approval. The document shall specify that potential tenants shall be screened to ensure that there is an average of not more than one (1) vehicle per dwelling unit at any one time. 20. The applicant shall provide a sprinkler system for all of the residential units within the two story buildings. The remaining one story units and the parking garages shall be sprinklered, if required by Fire Code. -2- ll-U-82 (Revised) Planning Commission Resolution No. 2399 (continued) 21. The applicant/property owner shall record a covenant obligating existing and future property owners to enter into reciprocal ingress/egress easements with the adjoining property to the west Said easements shall be entered into at such time in the future as the westerly parcel redevelops and the City can require the same of adjoining property owner. 22. The applicant shall return informally to the Architectural and Site Approval Committee for review of landscaping and building color prior to issuance of a building permit. 23. Driveway access to the single-family residential property located westerly of the development shown as Assessor's Parcel No. 359-7-9 on Exhibit A 1st Revision shall be provided in a manner consistent with the way in which the driveway functions prior to construction of this development. This may require removal of landscaping and the granting of easements over a portion of the Community Housing Developers' property.
