IN AN EXISTING RESTAURANT/BAR. APPLICANT: Ebrahim Khoshfahm (The Mother Lode) ADDRESS: 10055 Miller Avenue, Cupertino, California 95014 SUBMITTED: March 29, 1983 LOCATION: Northwest corner of Miller Avenue and Richwood Drive approximately 150 ft. south of Stevens Creek Boulevard --------------------------------------------- FINDINGS AND SUBCONCLUSIONS: Approval is subject to the findings as set forth on Page 1 and subconclusions as set forth in the minutes of the Planning Commission meeting of May 9, 1983. 1. The approval is based upon Exhibit A of Application 10-U-83 as may be modified by additional conditions contained herein. 2. In no case, shall noise levels produced by the dance floor or live music operation be audible at the exterior of the building. 3. Prior to initiation of the use permit, the applicant shall file with the Planning Department written agreements with Brentwood Market and St. John's Restaurant which allows the Mother Lode Restaurant to utilize parking spaces on their sites. 4. In the event noise, overflow of parking or public disorder becomes a problem, the Planning Director shall schedule this matter for a hearing before the Planning Commission for consideration of revocation of this use permit.
