HomeMy WebLinkAboutReso 23832-U-76 (Revised) RESOLUTION NO. 2383 OF THE PLANNING COMMISSION OF THE CITY OF CIJPERTINO RECOMMENDING APPROVAL OF A MODIFICATION OF AN EXISTING USE PERMIT TO ALLOW A RESTAURANT/BAR AND EXPANSION OF AN EXISTING 2,300 SQ. FT. BUILDING BY 1,000 SQ. FT. APPLICANT: Vallco Park, Ltd. (Vallco Village, Phase II) ADDRESS: 10050 North Wolfe Road, Cupertino, California 95014 SUBMITTED: February 1, 1983 LOCATION: West side of Wolfe Road approximately 900 ft. south of Homestead Road (opposite Pruneridge Avenue). -------------------------------------------------------------------------------- FINDINGS AND SUBCONCLUSIONS: Approval is recommended subject to the findings as set forth on Page 1 and subconclusions as set forth in the minutes of the Planning Commission meeting of March 14, 1983. CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions as enumerated herein shall apply. 15. The approval is based upon Exhibits A, B and Applicant's Letter dated January 31, 1983 as may be modified by additional conditions contained herein. 16. Prior to issuance of building permits, the applicant shall demonstrate compliance with the City's Construction Phasing Memo pertaining to traffic generation from the subject site, in either of the following forms: -Traffic study demonstrating existing traffic levels are sufficient low td allow the proposed expansion. -The transfer of excess trip capacity from another site within Vallco Park sufficient enough to cover projected traffic from this development. The Director of Public Works has the authority to approve the method of compliance outlined above... 17. The applicant shall demonstrate through the provision of permanent parking easements, restriping, or other options that sufficient parking exists to accommodate the proposed use at the following ratios: Commercial 1 space per 200 sq. ft of gross floor area Recreational: 2 spaces per court Office 1 space for every 230 sq. ft. of gross floor area Restaurant ---------------------------------------------------------------------- 1 space per four seats plus 1 space per employee -2- RESOLUTION NO. 2383 (continued) 2-U-76 (Revised) PASSED AND ADOPTED this 14th day of March, 1983, at a regular meeting of the Planning Commission of the City of Cupertino, State of California, by the following roll call vote: AYES: Commissioners: Binneweg, Blaine, Claudv, Koenitzer and Chairman Adams NAYS: None ABSTAIN: None ABSENT: None APPROVED: Is/ Victor J.
