RESOLUTION NO. 2372
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING APPROVAL OF A USE PERMIT TO ALLOW THE
RECONDITIONING OF ENGINE PARTS (MACHINE SHOP) IN AN
EXISTING RETAIL AUTOMOTIVE PARTS STORE.

SUBMITTED: January 4, 1983
LOCATION: Monta Vista Commercial Area on the northeast corner of Stevens
Creek Boulevard and Adriana Avenue.
FINDINGS AND SUBCONCLUSIONS:
Approval is recommended subject to the findings as set forth on Page 1 and subconclusions
as set forth in the Minutes of the Planning Commission meeting of February 14, 1983.
CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the special
conditions enumerated herein. In the event a conflict does exist, the
special conditions as enumerated herein shall apply.
15. The approval is based upon Exhibit A of Application 2-U-83 as may be
modified by additional conditions contained herein.
16. The approval is granted to operate a machine shop equal to. 600 sq. ft.
in area in conjunction with and incidental to the operation of the auto
parts retailing facility. All machine shop reconditioning work shall be
conducted within the enclosed area of the building and only upon parts
which have been removed from the vehicle. The applicant shall not be
permitted to store any materials or park inoperative vehicles nor shall
auto repair, engine removal or replacement functions be carried out on the
site. All loading and unloading of engine parts shall be conducted through
the auto parts store area or through the doors leading to the machine shop
area on the south side of the building.
17. On -site parking of inoperative vehicles is prohibited.
18. The applicant shall certify to the Building Official of the City of
Cupertino that all requirements of the Industrial Waste Inspector and
Cupertino Sanitary District are satisfied with regard to waste disposal
from machine shop operations.
19. The Planning Commission reserves the right to review the use permit at
any time in the future and on the basis of its findings to revoke the
permit if the machine shop operation is creating detrimental impacts on
the health and safety of the surrounding neighborhood. This use permit
shall be considered void if the auto parts store ceases to operate.

20. The applicant/property owner shall provide a landscaping plan incorporating
perimeter and parking lot landscaping which shall be fully irrigated.
Approval of the landscaping plan shall be subject to the review and
approval of the Architectural and Site' Approval Committee.
21. The applicant/property owner shall construct roof screens to hide the
roof equipment on the retail shops and the separate restaurant building
located on Stevens Creek Boulevard. Said screens shall be subject to the
review and approval of the Architectural and Site Approval Committee.
22. The applicant shall locate the trash enclosure and air compressor unit
such that the building shields them from the adjoining residential area.
23. The applicant shall retain an acoustical engineer to evaluate noise impacts
from the air compressor unit and from the machine shop operation to ensure
that no noise is audible at the northerly property line and that noise
levels will not disrupt normal speech (not to exceed 55 to 60 decibels)
within the adjoining commercial shops or in the surrounding parking lot
area. The acoustical engineer shall recommend design measures for the
building and compressor to ensure compliance with this condition. The
applicant/property owner shall extend the concrete block wall to align
with the building.
24. The applicant/property owner shall remove all debris and stored materials
from the area between the northerly property line and the building and
shall keep said area free and clear of all materials or obstructions.
25. The applicant shall certify that he has complied with all fire code
requirements with respect to storage of hazardous materials or operation
of the machine shop.
26. The applicant shall remove the auto parts signage fronting on Adriana
Avenue and paint the area over to match the existing building. Additionally,
the applicant shall remove the existing signs located on the south side of
the building and install new signage which complies with the new sign
program being adopted for the subject center. The new signage shall be
subject to the review and approval of the Architectural and Site Approval
Committee.
27. All landscaping and site improvements shall be completed prior to
operation of the machine shop.
28. The applicant/property owner shall participate in his proportionate share of
improvements on the realignment of Adriana Avenue to the degree that benefit
can be shown as established by assessment district law.
