OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING DENIAL OF A VARIANCE FROM SECTION 8.4
OF THE R1 ZONING ORDINANCE TO PERMIT A 10 FT. REAR
YARD SETBACK FOR AN ADDITION TO A SINGLE-FAMILY
HOME WHERE THE USABLE REAR YARD AREA WILL BE LESS
THAN REQUIRED BY ORDINANCE.
APPLICANT: Ranee R. Carlson and Jeraldine Mazzurco

LOCATION: West side of Betlin Avenue between John Drive and Clifford Drive
at 849 Betlin Avenue
FINDINGS:
1. The Planning Commission finds that the applicant has not demonstrated that
extraordinary circumstances exist which necessitates the proposed variance.
2. There are other opportunities for adding additional living space onto the
existing home.
3. The applicant has not demonstrated that the granting of the variance is
necessary for preservation of a substantial property right.
PASSED AND ADOPTED this 12th day of January, 1983, at a regular adjourned meeting
of the Planning Commission of the City of Cupertino, State of California, by the
following roll call vote:
AYES: Commissioners Binneweg, Blaine, Koenitzer, Chairman Adams
