HomeMy WebLinkAboutReso 236414 -TM -82 RESOLUTION NO. 2364 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING A TENTATIVE PARCEL MAP TO COMBINE FIVE EXISTING LOTS INTO ONE LOT. APPLICANT: John Vidovich (Dr. Joseph Brown) ADDRESS: 1307 South Mary Avenue, Sunnyvale, California 94087 SUBMITTED: December 17, 1982 LOCATION: West side of De Anza Boulevard approximately 250 ft. north of Lazaneo Drive and 450 ft. south of Mariani Avenue FINDINGS AND SUBCONCLUSIONS Approval is recommended subject to the findings as set forth on Page 1 and subconclusions as set forth in the minutes of the Planning Commission meeting of January 10, 1983. CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions as enumerated herein shall apply. 15. This approval is based upon Exhibit A of Application 14 -TM -82 as may be modified by additional conditions contained herein. 16. The applicant/property owners shall record a covenant entering into reciprocal ingress/egress easements with the adjoining property owners. The covenant shall continue the common driveway from Lazaneo Drive through the property to the northerly east/west running driveway aisle, thence, extending west to the westerly property line; and east to De Anza Boulevard. Additionally, the covenant shall record an easement to the 60' x 80' parcel labeled "Murphy" on Exhibit A of Application 14 -TM -82. 17. The applicant/property owner agrees to participate in his proportionate share of major off -site street improvements of a local or communitywide nature, such as major improvements to the intersection of De Anza Boule- vard and Stevens Creek Boulevard. Said agreement shall include, but not be limited to, agreement to participate in a local improvement district, or directly contribute to street improvements. If an assessment district is formed, the applicant/property owner's share would be determined by a cost benefit ratio as established by assessment district law. Boundaries for any district would be determined at a later date per assessment district law. The agreements to install the above improvements shall be submitted and recorded prior to or in conjunction with the issuance of building permits.
