RESOLUTION NO. 2144
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
ESTABLISHING CERTAIN CONDITIONS AND REQUIREMENTS
APPLICABLE TO APPLICATION 15-U-80 TO CONVERT A
THREE UNIT RESIDENTIAL APARTMENT BUILDING INTO A
SINGLE CONTINUOUS CARE RESIDENTIAL FACILITY FOR
UP TO 12 ELDERLY INDIVIDUALS. (USE PERMIT
APPROVED BY CITY COUNCIL AUGUST 18, 1980).

LOCATION: East side of Miller Avenue approximately 150 ft. south of

FINDINGS AND SUBCONCLUSIONS:
Approval is recommended subject to the findings as set forth on Page 1 and
subconclusions as set forth in the minutes of the Planning Commission meeting
of September 8, 1980.
CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the special
conditions enumerated herein. In the event a conflict does exist, the
special conditions enumerated herein shall apply.
15. The approval is based upon Exhibit A of Application 15-U-80 as may be
amended by additional conditions contained herein.
16. That the applicant shall comply with all requirements of the Building
Department as enumerated in the letter from Mr. Angelo Leber, Chief
Building Inspector, of July 9, 1980 and of the Central Fire Protection
District as enumerated in their letter of July 8, 1980 and requirements
of the Santa Clara County Environmental Health Department as enumerated
in their communication of July 22, 1980.
17. That the approval is granted for the continuous care residential facility
for elderly persons notto exceed.a.maximum of.:I2'-individuals:
18. The number of household pets (as defined in the Rl Ordinance) shall be
regulated in a similar manner as permitted in a three unit apartment'

Planning Commission of the City of Cupertino, State of California, by the
following roll call vote:
