HomeMy WebLinkAboutPC Reso 213119-U-80 12 -TM -79 RESOLUTION NO. 2131 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING THE APPROVAL OF A USE PERMIT AND TENTATIVE MAP TO ALLOW THE CONSTRUCTION OF A FIVE UNIT/LOT SINGLE-FAMILY DETACHED DEVELOPMENT IN A P (PLANNED DEVELOPMENT) ZONE. APPLICANT: May Investment, Inc. ADDRESS: 21060 Homestead Road, Suite .#120, Cupertino, California 95014 SUBMITTED: May 4, 1980 LOCATION: Northwesterly terminus of Scenic Boulevard just south of Stevens Creek Boulevard. FINDINGS AND SUBCONCLUSIONS: Approval is recommended subject to the findings as set forth on Page 1 and subconclusions as set forth in the minutes of the Planning Commission meeting of August 11, 1980. CONDITIONS: 1-14. Standard Conditions to the extent tVat they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions enumerated herein shall apply. 15. The approval is based upon Exhibit A 1st Revision of Application 19-U-80 and Exhibit A of Application 12 -TM -79 as may be amended by additional conditions contained herein. 16. The applicant shall design and construct an emergency vehicle access drive and turn -around from the northerly terminus of Carmen Road through the dedicated right-of-way of Stevens Creek Boulevard to the vicinity of the proposed dwelling on Lot 4. The emergency access drive and turn -around shall be reviewed by the Central Fire District and approved by the Director of Public Works. The applicant and subsequent owners of Lots 4 and 5 shall be given an en- croachment permit by the City to utilize said emergency access on the public right-of-way. Said encroachment permit and an appropriate recorded covenant shall clearly state that the emergency access is to be used strictly for emergency purposes and subject to revocation by the City at any time. The access shall be locked in accordance with Central Fire District standards. If, in the jugment of the Director of Public Works, the Carmen Road emergency access is not feasible, an emergency access from Stevens Creek Boulevard is authorized. The Director of Public Works shall approve the location, design and improvements plans of said driveway. 17. The project shall be reviewed by the Architectural and Site Approval Committee The applicant shall identify the extent of usable private yard space for each unit and the maximum area of private yard fencing. An informal tree planting plan shall be provided for the non -fenced area. The purpose of the tree planting plan is to partially mask building areas and grading scars from lands within the Stevens Creek Flood Plain and from Stevens Creek Boulevard (existing and future configuration) and to soften the future Stevens Creek Boulevard construction and improvement impacts from the project residents. -2- 19-U-80 12 -TM -79 PLANNING COMMISSION RESOLUTION NO. 2131 (continued). A scenic easement shall be recorded in favor of the City to ensure that fencing, accessory buildings and grading will not exceed the limits identified by the approved Architectural and Site Approval plan. Additionally, Covenants, Conditions, and Restrictions shall be recorded informing future property owners of the scenic easement and further informing future owners that each lot holder shall be responsible for maintaining his or her property regardless of the service easement requirment. 18. The applicant shall record a covenant ensuring that the owners of Lots 4 and 5 have equal access to and equal maintenance responsibilities for the mechanical lift. 19. The dwellings shall be designed in a manner to attenuate sound to comply with Title 25 of the California Administrative Code (45 Ldn).
