HomeMy WebLinkAboutPC Reso 2129RESOLUTION NO. 2129 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO REPORTING TO THE CITY COUNCIL THAT ITS ORIGINAL POSITION CONCERNING THE DRIVE -UP WINDOW AS REQUESTED IN APPLICATION 33-U-79 IS UNCHANGED _ AND THAT THE USE PERMIT SHOULD NOT BE GRANTED. WHEREAS, the Planning Commission at its meeting: of July 28, 1980 considered new information from the applicant and City Attorney, and WHEREAS, the Planning Commission concluded its deliberations and makes the following statements: Upon review of the criteria necessary to grant a Use Permit, the Commission finds that Criteria 3 and 4 set forth in the City Attorney's memo of July 25, 1980 cannot be satisfied. Those criteria are: 3. Would not impair the utility or value of the adjacent property or the general welfare of the neighborhood; and 4. Was not detrimental to the public peace, health, safety, morals or welfare. PASSED AND ADOPTED this 28th day of August, 1980, at a regular meeting of the Planning Commission of the City of Cupertino, State of California, by the following roll call vote: AYES: Commissioner NAYS: None ABSTAIN: None ABSENT: None ATTEST: James H.
