HomeMy WebLinkAboutPC Reso 212817-U-80 RESOLUTION NO. 2128 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF A USE PERMIT TO CONSTRUCT 67 RESIDENTIAL CONDOMINIUM UNITS IN A SINGLE 2-3 STORY BUILDING OVER UNDERGROUND PARKING. APPLICANT: Woodspring, Inc. ADDRESS: 125 Willow Road, Menlo Park, CA 94025 SUBMITTED: June 6, 1980 LOCATION: Homestead Road opposite Fallen Leaf Lane FINDINGS AND SUBCONCLUSIONS: Approval is recommended subject to the findings as set forth on Page 1 and sub - conclusions as set forth in the minutes of the Planning Commission meeting of July 30 , 1980. CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions enumerated herein shall apply. 15. The approval is based upon Exhibits A -2nd Revision, B, B -1, B-2. and Informational Exhibits applied with Application 17-U-80 as may be amended by additional conditions contained herein. 16. The approval is for a 67 -unit residential condominium project over underground parking. 17. The applicant shall increase the parking yield to equal 166 parking spaces for this project. 18. The lot line separating parcels 1 and 2 shall be eliminated through a Tentative Map submittal which shall also delineate the arrangement of the individual air space condominium units for the subject property. 19. The circulation pattern for the clearance for the underground parking garage shall he reviewed and approved by the Central Fire Protection District to ensure compliance with their standards. 20. The applicant shall demonstrate to the satisfaction of the Chief Building Inspector that the interior noise levels of said units comply with Title 25 of. the California Administrative Code relating to allowable sound levels in residential dwellings. 21. The applicant shall record a.covenant establishing accesseasementsand joint maintenance agreements for the jointly used access• driveway with the adjoining Springwood Apartment Project and delineating which parking stalls off the entrance driveway are assigned to the Springwood Apartments. Joint maintenance agreements for the access driveway and parking area shall be entered into 'with the Springwood Apartments. - 1 - 17-TJ-80 Resolution No. 2128 (continued) 22. The applicant shall participate in the City's Below -Market Rate Housing Program as adopted by the Planning Commission and City Council. Said commitment shall require the provision of six (6) below -market rate housing. units priced as per the requirements of said program. 23. The applicant shall provide for solar -assisted hot water heating systems to serve all of the units in the subject development. Placement of the solar collector panels shall he demonstrated to the Architectural and Site Approval Committee and shall he subject to the review and approval of the Chief Building Inspector. Buildings which are partially shaded or not ideally located with respect to sun angles shall either be accommo- dated through the use of panels on adjacent buildings or slightly modified roof design. 24. The applicant shall be required to contribute a fair share of the cost of installing a traffic signal at the joint entrance driveway if a signal becomes warranted within 5 years of the date of Council approval. The fair share shall be determined by the Director of Public Works.
