HomeMy WebLinkAboutPC Reso 212340-Z-80 RESOLUTION NO. 2123 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING THE APPROVAL OF A CHANGE OF ZONE AND PREZONE OF APPROXIMATELY 28 ACRES LOCATED WITHIN THE OLD RESTORED COMMERCIAL DISTRICT OF OLD MONTA VISTA. APPLICANT: City of Cupertino (Stevens Creek Boulevard/Monta Vista) ADDRESS: 10300 Torre Avenue, Cupertino, California 95014 SUBMITTED: July 3, 1980 LOCATION: Generally located on the north side of Stevens Creek Boulevard beginning at a point approximately 600 ft. westerly of Mann Drive to Southern Pacific Railroad right of way and southerly of Stevens Creek Boulevard between Orange Avenue and the Southern Pacific Railroad right of way. FINDINGS: 1. The recommendations for Areas C and D involve conventional zoning districts and, therefore, are not "conditionally" approved. 2. The prezoning and rezoning recommendations for Areas A and B involve a Planned Development zoning district and, therefore, the Conditions of approval outlined below apply. CONDITIONS OF APPROVAL FOR AREAS A AND B OF APPLICATION 40-Z-80 1-14. Standard Conditions to extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions as enumerated herein shall apply. 15. The approval is based upon the zoning descriptions contained within the legend of Exhibit A of Application 40-Z-80 as may be amended by additional conditions contained herein. 16. The land use types, land use intensity and the circulation planning within. Areas A and B shall reflect the adopted Specific Plan for Old Monta Vista labeled "Stevens Creek Boulevard Plan Line Action Plan". The guidelines contained within the specific plan including the recorded plan line for Stevens Creek Boulevard and its intersections with side streets shall be utilized to guide subsequent use permit and tentative map proposals sub- mitted within the zoning boundary for Areas A and B. 17. The conditions of approval for zoning Applications 1-Z-79, 21-Z-79, 27-Z-79 and 5-Z-80 and use permit Applications 31-U-79 and 1-U-80 shall remain in force unless there is a conflict with conditions outlined in this document and/or the Old Monta Vista General Plan as amended.
