RESOLUTION NO. 2112
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
APPROVING A USE PERMIT TO ALLOW SETBACK AND HEIGHT
EXCEPTIONS TO ACCOMMODATE A SOLAR PANEL RACK
STRUCTURE IN AN AGRICULTURAL -RESIDENTIAL ZONING
DISTRICT.

FINDINGS AND SUBCONCLUSIONS:
Approval is recommended subject to the findings as set forth on Page 1 and
subconclusions as set forth in the minutes of the Planning Commission meeting
of July 14, 1980.
CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, the special conditions enumerated herein shall apply.
15. The approval is based upon Exhibits A and B of Application 18-U-80
as may be amended by additional conditions contained herein.
16. Approvals granted under this Resolution are contingent upon future
City Council approval of an amendment to the A/Al Ordinance which
would establish a use permit procedure to vary from setback and
height regulations for solar equipment. Further, the approvals
specified by this Resolution shall not be effective until thirty
(30) days after the second reading of subject amendment by the
City Council
17. All solar energy system equipment to be located on the subject property
shall require a building permit and is subject to approval by the
City staff.
PASSED AND ADOPTED this 14th day of July, 1980, at a regular meeting of the
Planning Commission of the City of Cupertino, State of California, by the
following roll call vote:
AYES: Commissioners Adams, Claudy, Johnson, Chairman Koenitzer
NAYS: None
ABSTAIN: None
ABSENT: Commissioner Blaine
