RESOLUTION NO. 2089
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
APPROVING A USE PERMIT TO ALLOW REDUCED SETBACKS FOR
THE ACCOMMODATION OF A SOLAR ENERGY SYSTEM IN A
SINGLE-FAMILY ZONING DISTRICT.

SUBMITTED: March 17, 1980
LOCATION: North side of Bahl Street approximately mid -block
between Vista Knoll Boulevard and Ainsworth Drive.
FINDINGS AND SUBCONCLUSIONS:
Approval is subject to the findings as set forth on Page 1 and subconclusions as
set forth in the minutes of the Planning Commission meeting of June 9, 1980 and
special findings as listed below:
That the applicant has not sufficiently satisfied the Planning Commission
of the structural integrity of the tank to endure potential earthquake "G"
forces and, therefore, constitutes a physical hazard to public safety -,and
requires relocation to an area within the plan line of the house and pool
area.
That if the tank remained in its present location, it would be illegal and,
therefore, is not appropriate.
That the location of the pump and hot water storage equipment within the
side yard setback line of the property is acceptable even though it is
outside of zoning code requirements on the basis that this is a solar
system and its location is functionally ideal in that spot.
CONDITIONS OF APPROVAL:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, the special conditions enumerated herein shall apply.
15. The approval is based upon Exhibits A, A -1, B and B-1 of Application
6-U-80 as may be amended by additional conditions contained herein.
16. Start-up operations of the subject solar energy system shall not be
permitted until such time as all conditions contained in this resolution
are resolved to staff's satisfaction.
17. Approval of the solar water storage tank depicted in Exhibit A-1 is contingent
upon satisfactory resolution of the following conditions:
1. Verification of precise property line.
2. Modification to ensure that fence post footings do not encroach into
the adjacent property.
3. The 1,000 gallon solar water tank be relocated so that it is more
than 7 ft. from any side or rear property line and that it be buried
at least one-half of its height into the ground.

18. Fire protection measures as deemed necessary by the Uniform Building
Code shall be provided for all structures approved under this application.
PASSED AND ADOPTED this 9th day of June, 1980, at a regular meeting of the
Planning Commission of the City of Cupertino, State of California, by the
following roll call vote:
