RESOLUTION NO. 2070
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING APPROVAL OF A REVISED TENTATIVE MAP TO
DIVIDE APPROXIMATELY ONE ACRE INTO FIVE SINGLE-FAMILY
DETACHED LOTS.

SUBMITTED: April 7, 1980
LOCATION: North side of Orogrande Place approximately 230 ft. westerly of
Stelling Road.
Approval of the revised tentative map is recommended subject to the findings and
subconclusions as outlined in Planning Commission Resolution No. 2021 and further
subject to all conditions set forth in Planning Commission Resolution No. 2021
with exception to the following amended conditions.
15. The approval is based upon Exhibit A 2nd Revision of Application 26 -TM -79
(Revised) as may be modified by additional conditions contained herein.
18. The applicant shall provide an easement allowing the adjacent westerly
property owner access over the 18 ft. wide private driveway and 20 ft. wide
alternate access easement extending from the easterly boundary of Lot 2 to
Stelling Road, at such time as said adjoining property develops. A covenant
shall be recorded requiring the owners of Lots 1 and 2 to maintain said
private driveway and alternate access easement to Stelling Road with the
stipulation that'a future developer of said westerly property shall be re-
quired to execute an agreement to participate in the driveway maintenance.
The degree of participation shall be determined by the City in conjunction
with the review of a subsequently filed development proposal.
19. The applicant shall attempt to obtain land separating Lots 3, 4, and 5 from
the Orogrande Place street right of way and dedicate same to the City for
roadway purposes. In the absence of a negotiated agreement to acquire said
land, for a reasonable price, the City shall utilize its power of :condemnation
to acquire said land with all condemnation costs to be borne by the applicant
21. The approval of the application is contingent upon the acquisition of an un-
conditional encroachment permit to use State right of way for Festival Drive) a
local street. In the event acquisition of an unconditional encroachment permit to
use State right of way or relinquishment of State right of way to the City of
Cupertino cannot be accomplished, the alternate access easement to Stelling
Road, as shown on Exhibit A 2nd Revision, shall become an access easement granted
to Lots 1 and 2 assuring access for those lots to Stelling Road. The alternate
access easement shall be improved to a width of 18 ft. in a manner as required
by the Director of Public Works.
