RESOLUTION NO. 2063
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING APPROVAL OF A USE PERMIT TO CONSTRUCT
FIVE SINGLE-FAMILY DETACHED DWELLINGS IN A P
(PLANNED DEVELOPMENT WITH SINGLE-FAMILY RESIDENTIAL
INTENT) ZONE.

LOCATION: North side of Almaden Avenue approximately 100 ft. westerly of
Orange Avenue.
FINDINGS AND SUBCONCLUSIONS:
Approval is recommended subject to the findings as set forth on Page 1 and
subconclusions as set forth in the minutes of the Planning Commission meeting
of April 14, 1980.
CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, the special conditions as enumerated herein shall apply.
15. The approval is based upon Exhibit A 2nd Revision and B of Application
7-U-80 as may be modified by additional conditions contained herein.
16. The Director of Planning and Development, or his or her designee, shall
approve the detailed architectural designs for the five dwellings based
upon the following guidelines:
A. The upper story of Units 2, 3, and 4 which face rear yards as defined
by the 20 ft. setback notation on Exhibit A lst Revision, shall be
devoid of all windows except bathroom windows. Bathroom windows
shall be comprised of frosted glass and the operable section of said
windows shall be designed to prevent individuals from viewing into
the yards of adjoining properties.
B. Units 1 and 2 shall contain an exterior, open porch which adjoins the
southern elevations of both units and the easterly elevation of Unit
1 and westerly elevation of Unit 3. Units 3, 4, and 5 shall contain
at least 100 sq. ft. of open porch. The architectural design of the
buildings including porch areas, shall contain design elements
described on Exhibit B. The porch elements shall generally adhere
to the setback distances described on Exhibit A lst Revision. The
minimum front yard setback for Units 1 and 2 shall be 15 ft. from the
building line of the porch to the common property line/street right-
of-way line for Almaden Avenue.

17. The private driveway shall be constructed to the standards of City
streets subject to the approval of the City Engineer. A reciprocal
joint access and maintenance agreement shall be prepared to ensure
access to each lot for future lot owners and emergency and public
servicing vehicles and to ensure that said driveway is properly
maintained. The agreement shall be reviewed and approved by the
Director of Public Works and City Attorney prior to recordation.

Planning Commission of the City of Cupertino, State of California, by the
following roll call vote:
