HomeMy WebLinkAboutPC Reso 216322 -TM -80 RESOLUTION NO. 2163 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF A TENTATIVE MAP TO ADJUST A LOT LINE BETWEEN TWO EXISTING PARCELS TO REDUCE THE SIZE OF ONE PARCEL FROM ONE ACRE TO .5 ACRE AND INCREASE THE SIZE OF A SECOND PARCEL FROM 1.8 ACRES TO 2.3 ACRES. APPLICANT: Debcor Corporation (Richard H. Childress) ADDRESS: 1173-B Saratoga -Sunnyvale Road, San Jose, California 95129 SUBMITTED: November 7, 1980 LOCATION: North side of Lindy Lane opposite the intersection with Lindy Place (approximately 500 ft. westerly of Terra Bella Drive). -------------------------------------------------------------------------------- FINDINGS: The Commission finds that the proposal does not involve the creation of any new lot nor does it isolate or negatively impact the property rights or interests of the surrounding property owners. For this reason it is determined that the proposal does not conflict with the requirements of Condition 13 of Resolution No. 468 (Application 19-Z-67). CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditons as enumerated herein shall apply. 15. That the approval is based upon Exhibit A 1st Revision of Application 22 -TM -80 as may be amended by additional conditions contained herein. 16. The applicant shall dedicate 20 ft. for public street purposes along the entire easterly property line of Parcels A and B, and reserve for future dedication a possible cul-de-sac at the junction of Parcels A and B along the easterly property line. The precise location shall be illustrated on an Exhibit to be presented to the City prior to City Council approval of the final map. Additionally, the applicant shall enter into a deferred agreement to provide half -street improvements, to public street standards, along the entire easterly property line of Parcels A and B including the possible cul-de-sac. Said agreement shall be recorded against both Parcels A and B and shall be implemented at such time in the future as determined appropriate by the City. 17. The proposed property line between Parcel A and B shall be shifted or the septic drainfield for Parcel A moved such that the property line does not cross the drainfield and such that the drainfield is located fully on Parcel A. - 2 - Planning Commission Resolution No. 2163 (Continued) 22 -TM -80 PASSED AND ADOPTED this 8th day of December, 1980, at a regular meeting of the Planning Commission of the City of Cupertino, State of California, by the following roll call vote: AYES: Commissioners Adams, Blaine, Claudy, Chairman Koenitzer NAYS: None ABSTAIN: None ABSENT: None APPROVED: /s/ R.
