HomeMy WebLinkAboutPC Reso 215118 -TM --80 RESOLUTION NO. 2151 IF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF A TENTATIVE MAP TO SUBDIVIDE APPROXIMATELY 1.25 ACRES INTO 13 INDIVIDUAL OWNERSHIP TOWNHOUSE PARCELS AND 1 PARCEL TO BE HELD IN COMMON OWNERSHIP. APPLICANT: .Monta Vista Development Company ADDRESS: 21900 Stevens Creek Boulevard, Cupertino, CA 95014 SUBMITTED: August 29, 1980 LOCATION: Adjacent to and southerly of Olive Avenue and Pasadena Avenue FINDINGS AND SUBCONCLUSIONS: Approval is recommended subject to the findings as set forth on Page 1 and subconclusions as set forth in the minutes of the Planning Commission meeting of October 13, 1980 CONDITIONS:' 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions enumerated herein shall apply. 15. That the approval is based upon Exhibit A of Application 18 -TM -80 as may be modified by additional conditions contained herein. 16. The applicant shall comply with all of the conditions of approval enumerated under the R1C zoning ordinance including those relating to streets and public improvements. 17. The applicant shall have the ability to modify the proposed property line for Lot 13 to accommodate the private yard area as identified on Exhibit C of Application HC -51,529.1. Additionally, the applicant shall adjust the lot line for parcel #1 to provide at least 5 ft. between the public right of way and the beginning of the rear yard area. Said 5 ft. area shall be landscaped to be consistent with the common area landscaping along Olive Avenue subject to the review and approval of the staff at the building permit level. 18. The applicant shall record a covenant restricting sales price, resale procedures, etc., per the requirements of the City's Below Market Rate Housing Program on • one unit within the subdivision.
