APPLICANT: Robert Altevers and Company ADDRESS: 3475 Via Oporto, Newport Beach, California 92663 SUBMITTED: September, 1980 LOCATION: Southeast corner of Stevens Creek Boulevard and Portal Avenue ------------------------------------------------------------------------------------- Approval of the use permit is recommended subject to the findings and subconclusions as outlined in Planning Commission Resolution No. 1882 and further subject to all conditions set forth in the City Council Action Letter dated October 10, 1978 with exception to the following amended condition. Condition 18 (amended). This permit is subject to review at any time for cause. The Planning Commission shall hold a public hearing after notification of all property owners and residents within 300 ft. of the facility, and shall determine if the permit is to be revoked. Additionally, the requirement of the Fire Marshall asset forth in his memo of October 6, 1980 shall be complied with within one month of the date of this resolution. The approval of this application was made subject to the original conditions imposed by the Planning Commission with the added provisions that there will be no live music; the dance floor shall consist of 1.80 sq. ft.; that a security guard will be provided from 10 p.m. to 2 a.m. for a period of six months subject to renewal, if found to be needed, and that the use permit is valid for a period of one year with renewal contingent upon a public / hearing before the Planning Commission. In the event a conflict does exist, the special conditions enumerated herein shall apply. 15. That the approval is based upon Exhibits A, B and C of Application 17-U-78 as may be amended by additional conditions contained herein. 16. That this approval allows the applicants to have dancing with the provision that the dance floor area shall not exceed 180 sq. ft. and shall be located as shown on the approved exhibits. Live music is not permitted. 17. In no case, shall noise levelsproduced by the facility be audible at the perimeter property line of the Orchard Valley Market Place Shopping Center. The applicant shall immediately abate any violation of this provision. 18. This permit is granted for a period of one year from the opening of the facility. At the end of said year, the Planning Commission shall hold a public hearing after notification of all property owners and residents within 300 ft. of the facility and shall determine if the permit is to be extended. 19. A security guard shall be provided for a period of six months commencing on the date of opening of the facility. Security may be required for a longer period if deemed appropriate by City staff.
