A RESOIlJI'ION OF '!HE CI'lY CXXJNCIL OF THE CI'lY OF ClJr'J!a<J.'.LÑO
PRJVIDING FOR LIEN ASSEESMENTS AND FOR '!HE OOL'ŒCI'ION OF
SAME RFSUI1I'ING FRCM THE ABATEMENT OF :roBLIC NUISANCES
WHEREAS, after due notice a public hearing thereon was held at a
regular meeting of the City Council on December 15, 1986 at which t:iJne the
City declared that the growth of wee:m, the aCClIll1l.Ùation of ga¡::ba.ge,
refuse, cuttings am other combustible trash upon certain properties as
des=ibed in City of CUpertino :Resolution No. 7047 to be a public
nuisance; am
WHEREAS, from the evidence presented, both oral am written, the City
Council acquired jurisdiction over am abate said nuisances; am
WHEREAS, after due notice of a report on proposed assessments was sent
by registered letter to the affected property owners at the address
appearing on the tax roles, which letter advised that a hearing would be
held at the City Council meeting of August 17, 1987; am
WHEREAS, said hearing was held by the city Council at the t:iJne and
place fixed for the receiving am considering of such report am proposed
assessment.
NCM, 'IHEREFORE, BE IT RESOLVED that the City Council does hereby
confinn that the costs of abating said nuisances shall be as set forth on
Exhibit "A" attached hereto am made a part hereof am said costs shall
constitute a lien on the affected property.
BE IT FURl'HER RFSOLVED that the County Fire Marshal shall cause the
amount of the assessments to be entered on the County Assessment Roll
opposite the description of the particular property, which assessment so
entered on the County rolls shall be collected together with all other
taxes thereon upon the property at the same t:iJne am in the same manner,
as general City taxes are collected am shall be subject to the same
penalties am interest, and the procedure and sale in the case of
delinquency as provided for City taxes.
