A RESOllJ'I'ION OF THE CI'lY CXXJNCIL OF THE CI'lY OF CXJ.I:'.I!;KJ:INO
SEITING DATE FOR OONSIDERATION OF ANNEXING AREA DESIGNA'IED
''UPLAND WAY 87-03", PROPERI'Y LOCATED CN THE WEST SIDE OF UPlAND
WAY saJIH OF RAINInl œIVE, APPROXIMATELY 0.050 ACRE,
SONNENIBICK
WHEREAS, the city Council of the City of CUpertino has received a
request for annexation of territory designated ''Uplam Way 87-03" from
property owners, Paul am Marta Sonnenblick; am
WHEREAS, the property, O. 5o± acre on the west side of Upland Way south
of Rainbow Drive (Am 366-3-43) is =ntiguous to the city of CUpertino and
is within its urban service area; and
WHEREAS, annexation would provide for use of City services; am
WHEREAS, this territory is uninhabited am was prezoned on September
21, 1981; am
WHEREAS, the City of CUpertino, as Lead Agency for erwironmental
review completed an initial study am granted a Negative Declaration for
annexation; and
WHEREAS, the County SUrveyor of Santa Clara County has found the map
am description (Exhibits "A" am "B") to be in accordance with Government
Code Section 56826, the boundaries to be definite am certain, am the
proposal to be in compliance with IAF'CX)'s road annexation policies; and
WHEREAS, the fee set by the County of Santa Clara to cover staff costs
for above certification has been paid; am
WHEREAS, as provided in Government Code Section 56826 the city Council
of the city of CUpertino shall be conducting authority for a
reorganization including an annexation to the City; am
WHEREAS, Government Code section 56837 provides that if a petition for
annexation is signed by all owners of land within the affected territory
the City Council may approve or disapprove the annexation without public
hearing;
NCM, 'IHEREFORE, BE IT RESOLVED, that the city Colmcil of the City of
CUpertino hereby initiates annexation proceedings am will consider
armexation of the territory designated ''Uplam Way 87-03" at their regular
meeting of October 12, 1987.
PASSED AND AOOPl'ED at a regular meeting of the city Council of the
city of CUpertino this 8th day of SeptembelJ 1987 by the following vote:
