AGREEMENT FOR PREPARATION OF
DRAFT ENVIRONMENTAL IMPACT REPORT
AGREEMENT made by the CITY OF CUPERTZNO, a municipal
corporation of the State of California, hereinafter referred to
as "City% and URS RESEARCH COMPANY, a California corporation.,
hereinafter referred to as "Research".
R E C I T A L S
A. In connection with the proposed Hewlett-Packard
plant expansion in City, City has determined that the project
may have a substantial effect upon the environment; and
B. Accordingly, the Environmental Review Committee
of City has determined that an Environmental Impact Report will
be required in connection with said project ; and
C. The Environmental Review Committee of City has
selected Research to prepare a draft Environmental Impact Report
with respect to said project.
NOW, THEREFORE, City and Research hereby agree as
follows :
1 . Research shall prepare a draft Environmental
Impact Report with respect to the proposed Hewlett-Packard
plant expansion in City , based u,,:ron existing data, and any
additional data which may have to be developed properly to
assess the effect of the project upon the environment , in ac-
cordance with City °s Environmental Assessment Procedure , dated
March 27, 1973, emphasizing therein the questions of traffic,
noise and air pollution.
2. Research shall supply City with four preliminary
copies and 29 finished copies of the draft Environmental Impact
Report.
3. Milton Staackmann shall act as Project Manager
for the report , and Mr. Staackmann shall be requ':red to attend
up to four mee' tngs of the City Council or Planning Commission
of City, in connection with the review and presentation of the
draft Environmental Impact Report.
4. City shall pay Research, upon completion of the
services hereinabove described, a fee based upon a time and
material basis , with the total price not to exceed Two Thousand
Four Hundred Dloliars ( t2 ,400. 00) . Direct i.abor shall be billed
in acco-dance with the Schedule of Billing Rates for Individuals
which is Marked Exhibit "A" , and is attached hereto and mace a
part hereof by reference . Other direct charges shall be billed
at Research' s cost . Any additional services provided by pe-search
beyond those services described above shall be billed separ_ ely ,
on a time and material basis , but such additional services shall
not be performed , and Research shall not be entitled to receive
any compensation there 'or, unless prior written approval of such
additional services has been given by City .
5 . Research represents to City that it is skilled in
the professional calling . .-essary to perform the services herein
above described, and that it has not been employed by Hewlett-
Packard Company in connection with the proposed plant expansion

In City except for preparation of preliminary material associated
with environmental assessment.
" 6. City shall make available to Research all infor-
mation and data which it has in its possession, or under its con-
trol, which may be helpful to Research in performing the services
herein above described.
7. All data developed, together with the draft En-
vironmental Impact Report, shall become the property of City .
8. the status of Research shall be that of an inde-
pendent contractor, and Research s'-,all indemnify and save harm-
less City from any and all claims , demands or liability by or to
any person for injuries to person or damage to property arising
out of its performance of the services prcvided for by this
Agreement.
9. This is the whole agreement of the parties , and
may not be modified except by an instrument in writing executed
by the party against whom the enforcement of any modification,
waiver or discharge is sought.
IN WITNESS WHEREOF, the parties have executed this
Agreement , in duplicate , this 4th day of SeptemhPT , 1973.

Hewlett- Packard Facility

At its meeting of November 5, 1973, the City Council of the City of
Cupertino held a public hearing to consider the Environmental Impact
Report for the expansion of Hewlett-Packard facilities located at the
southeast corner at the intersection of Wolfe Road and Homestead Road.
The proposed project is for the construction by Hewlett-Packard Company
of an additional 964,500 square feet of industrial building space within
Vallco Park, bringing the total square footage of the Hewlett-Packard
fac'.lity to 1,306,700 square feet.
The decision of the City Council was to approve the project and accord-
ingly approved City of Cupertino Application 11-8-73 authorizing the
issuance of the use permit subject to specified conditions and City of
Cupertino Application 11-TM-73 also subject to specified conditions.
A decision also was made that the project will have a significant impact
an the environment. An Environmental Impact Report for this project has
been prepared and was reviewed and given consideration during the afore-
mentioned public hearing.
r At the conclusion of the public hearing, the City Council directed the
City Clerk to file with the County Clerk of. Santa Clara County this Notice
of Determination pursuant to the duly adopted environmental assessment pro-
cedure of the City of. Cupertino.
