01,August 17, 1971 the Board authorized the filing of an application for
ini,t.ial funding for forty positions under the federal Emergency Employment
Act of 1971. This application involved $150,390 of federal funds, to be
ut,ed in the interim while a "full-funding" program application could be
dtiveloped and approved by the federal government. The initial funding
application was approved the day after it ►eas submitted to the federal
0repartment of Labor, and some of the positions have already been filled.
Originally the federal instructions provided for the full-funding application
to bee submitted to the 0epartme-.t of Labor within 30 days of the effective
date of the interim funding grant (August 30, 1971). This instruction has
ju%t been revised. it is now required that the County government submit
the full-funding application nti later than September 10. 1971.
The full-funding grant is extremely important, as it not only provides for ,
the financing of those positions to be employed by the County, butit also
includes the funding for those positions to be hired by the cities other
than San .lose, Sunnyvale and Santa Clara, which received direct federal
grants. in other words, the full-funding appl ,cation provides for the
distribution and use of the total County allocation ($1 ,324,500) between
the County government and the smaller cities.
Because of the critical timing required by the new federal instructions,
it has been necessary to work out the proposed sub-allocations with the
cities and all of the details related to the preparation of the full-
funding program on a crash basis. With this in mind, presented below is
a summary of the program: which is submitted for your approval.

The federal program guidelines provide for the County to allocate, on an
equitable basis, amounts to the various cities not separately receiving
allocations under the PEP program. Factors to be considered by the County
included population of the cities and severity of unemployment. Because
there is no adequate data available concerning unemployment within individual
cities, it was necessary to consider the unemployment level to be basically
the ;name in all of these cities. Population then became the most logical
and simple method of arriving at "equitable allocations."
After several meetings with the staffs of the cities, it was determined
that an amount per capita equal to the average received directly (from
the federal government) by Sunnyvale and Santa Clara ($1.485) would

***The County amount includes $6,300 reflecting a late adjustments in
the federal allocation, plus $4,693 for Monte Sereno and $10,1
for Los Altos Dills, as they did not indicate an interest in
participating in the program.
Use of County Share
The 5907,153 amount left for County use will finance 123 position to be
assigned to various County programs, as indicated in the attached listing.
This consists of funding the 40 positions authorized in the initial grant
for a full twelve months and an additional 82 positions for eleven months
each plus one position for three ovinths. As ir, the case of the initial
grant application. the federal government will blinance the entire salary
cost of each position including fringe benefits. The County share (10%)
of the total program cost will be in-kind, consisting of supervisor's time,
materials, etc.
Salary Ordinance
In order to implement the fhjll-funding program, it will be necessary to
mend the Salary Ordinance to establish the additional 83 positions (40 were
established in conjunction with the initial funding program) . In addition
the amendment should also include extra positions (listed below) which
can be used to ensure maximum use of the total federal allocation.

This flexibility will permit the periodic hiring of additional persons
to the extent of accumulated salary savings during the term of the grant.
The additional positions may also be useful in conjunction with the sub-
grants to the ten cities for which the County goverment is also responsible
under the progr,xm. (it may actually be more practical in sme cases to
assign a position from the County pool and reduce the city°s allocation
to cover the cost than to have the city go through a separate recruiting
and hiring effort.) As an exampie, the City of Saratoga has indicated
that it wants an additional Deputy Sheriff assigned to worm in its
co nunity and will cover the full cost from its allocation.

Action Required
As indicated above, the timing related to the full-funding grant application
is critical (must be filed by Friday) . Yet to be completed is the addition
of the cities' programs to the County program (summarized above) to form the
full application and planned usage of the total federal allocatioD.
It is recommended that the Board:
1) authorize the County Executive or Assistant County Executive
to sign the program application and such adjustment documents
and reports as necessary to meet the U.S. Department of Labor
and program requirements; and
Z) adopt a Salary Ordinance Amendment, on an emergency basis (to

in two newspapers of general circulation in the area. The

Comments will not be required for the Application for Initial
Funding. however, all Program Agents are required to Burnish

Funding to all Program Agents in the State. and also to con-
cerned labor organizations. Such copies should be furnished
no later than the time the Applications are tranamiLted to the

This is an agreement between the County of Santa Clara
(County) and the City of Cupertino (City) concerning the Emergency
Employment Act of 1971 (Act).
WHEREAS, County has been designated as a Program Agent and
receive funds under the Act, and
WHERFAS, City is desirous of providing unemployed and under-
employed persons with transitional employment in jobs providing
needed public services, it is agreed that:
1. Subgrantee: City shall be a subgrantee of County and
shall be awarded the stann of $29,997 `er fiscal year 1972.
2. Compliance: City shall comply with all applicable pro-

AGREEMENT BETWEEN COUNTY OF SANTA CLARA AND
CITY OF RELATING TO
THE R+GERCY EMPLOYPMT ACTOF .1971
This is an agreement between the County of Santa

Clara (County) and the City of (City)
concerning the Emergency Employment Act of 1971 (Act) .
WHEREAS, County has been desicn.ated as a'Prograqu
Agent and received funds under the Act, and
AREAS, City is desirous of providing unemployed
and under employed persons with transitional employment
in jobs providing needed public services, it is agreed
that
1. Subgrantee: City shall be a subgrantee of
County and shall be awarded the sum of $
for fiscal year 1972.
2. Compliance: City .shall comply with all applicable
provisions of the Act, regulations, and terms and conditions
of the grant to County. County shall make available to
City copies of the Act, regulations a--id conditions governing
the grant.
3. Reports: City shall provide County with all
reports and records required by the Act. County shall
provide City with the desired format for these reports.
4. Records: City shall maintain records in the manner
prescribed by .the Department of Labor and make: them available
for audit.
