Relocation of Company 60 HV pole -Line to accamodate C'Lty's constriction
of a park in the vicinity of Linda Vista. Drive, GA 33
Gentlemen:
Attached, in duplicate, is a flat sum contract covering the estimated
cost for the subject relocation.
Also attached, in duplicate, :a a Joint Use Agreement which covers both
the quitclaiming of our existing land rights and the acquisition of new
rights for the relocated line.
All the attached documents have been executed on behalf of the Company.
Please review the documents and, if satisfactory, have them executed by
the proper City officials and return the copies marked "P. G. and E. CO.
COPY" to our San Jose Division Land Department, 20065 Stevens Creek Boul-
evard, Cupertino. California 95014, to the attention of C. J. Smith.
Please include a certified copy of the resolution authorizing the signing
of the documn ts. Should you decide to have the Joint Use Agreement
recorded, please have the County Recorder fill in the recording information
on the attached card and return it to us.
Please direct any questions you may have concerning this matter to Mr.
Smith, at the Cupertino address, telephone 253-2010, extension 27.

Excerpt from Minutes of the Regular Meeting of the City Council
of the City of Cupertino, March 17, 1969:
"City Manager Storm asked that the agreement be authorized for
execution by the Mayor and the City Clerk in connection with the reloca-
tion of the pole line by PG&E from the newly acquired park site.
Councilman Beaven moved, Councilman Dempster seconded and it was
passed by voting 3 - 2 to authorize the execution of said agreement for
moving the pole line at a cost of $2,410.34."

THIS AGFMZMT entered into this 17th day of Marcia
19 69, by and between CITY OF CUPERTINO, hereinafter called City, and PACIFIC GAS
AND ELECTRIC CCHPANY, hereinafter called Company,
W I T N E S S E T H
'WHEREAS, City contemplates construction of a park in the vicinity of Linda
Vista Drive, Santa Clara County, California: and
+WHEREAS, Company maintains certain electric pole line facilities, hereinafter
called f.;;ilities, which will interfere with City's project; and
TER.AS, City has requested and Company is willing to rearrange said facilities
to eliminate such interference;
NOF,4, THEREFORE, it is hereby mutually agreed as follows:
1. Upon the receipt by Company of notice in writing from City, Company
will commence and thereafter diligently prosecute the rearrangement of its facil-
ities as nearly as possible in accordance with Company's Drawing No. SJL-6910
attached hereto and marked Exhibit A. provided, however, that Company shall not be
obligated to perform such woz4: until it has acquired necessary land rights in fom
satisfactory to Company for any of Company's facilities which must be replaced in
a new location.
2: In the event the construction of temporary facilities is necessary,
Company may use lands owned or controlled by City for the purpose of making such
temporary installation provided that City shall have approved the location thereof.
Upon completion of construction of such facilities in their permanent location,
Company shall remove all temporary facilities.
3. Upon ccmple^tion of the work and within thirty ('10) days of receipt of
Carmparq's invoice, City shall pay Cam the amount of $2,410.33.

4. City shall convey or cause to be conveyed to Company all necessary
land or land rights in a form satisfactory to CQ-.-any to permit Compaary to
install its facilities on lands owned by City; provided, however, that in
satisfaction of this obli.ation of City, City and Company shall enter into a
Joint Use Agreement for that portion of said facilities as is shown in blue
on Exhibit A.
5. The provisions hereof shall inure to the benefit of an, be binding
upon the respective successors and assigns of the parties hereto.
IN WITNESS IvIIEREOF, the parties have executed this Agreement by their duly
authorized officers this day and year first hereinabove set forth.
