Subj: REPORT OF DIRECTOR'S DECISION REGARDING PLANNING APPLICATIONS
Chapter 19.31 of the Cupertino Municipal Code provides for administrative approval of
minor changes in projects. The Ditector reports his decision to the City Council and
Planning Commission in time to allow arty Councilmember of Planning Commissioner
to appeal the decision.

Description
Minor Modifption W allow the sale of live fish on no more than 20% of the gross square footage of a pet supply
store.
The Director of Community Development dams the modification minor and approves the change. Approval is
effective January 20, 1993. The fourtan (14) calendar day appeal period will expire on February 3, 1993.

It was a pleasure speaking with you today concerning our proposal to expend Into the
vacant space next door. Petco currently occupies 4,440 SF at the above-captioned
• premises and is proposing to lease from the Landlord an additional 2,220 SF. Petco
sells only pet food and supplies and does not sell or board live animals of any kind.
However, we do propose to use approximately 20°~ of the store for the sale of live
tropical fish and accessories. Is this perm(tted under the City of Cupertino zoning
ordinance?
Would you please Indicate by stating whether ft is approved or disapproved and
signing In the space below in order for us to go forward with our lease with our
Landlord.
