BACKGROUND: Goodwill Industries currently operates a "small mobile collection facility" on Stevens Creek Boulevard (Summerhill side). As a result of Summerhill's recent tentative map and conditional use permit approval, Goodwill would like to relocate to the proposed 7,500 sf. commercially zoned site to provide recycling services on the west side of town. Ordinance No. 1426 permits the Planning Director to approve small recycling collection facilities on commercially zoned parcels, subject to specific operational standards (Section 6.2). Planning Commission: The Planning Commission unanimously denied the appeal and therefore supports the Goodwill operation. Chairperson Mahoney abstained because he sits on their Board of Directors. • Additional conditions were enacted following testimony. They include condition No.7 & 8 of Resolution No. 4544. ARR:<llalll: The appellant is concerned about the Bateh Brothers upkeep of the area adjacent to the trash dumpster, the trucking activity drawn to the commercial store and property values decreasing as a result of the Goodwill trailer. The appellant is also concerned that the Goodwill trailer will increase traffic, dust and noise to the residents and that other recycling facilities, have not kept their operation clean. AkRli~aut: Goodwill Industries explained that their operation occupies an area of not more than 500 square feet and which accepts donations of recyclable materials from the public. The recyclable materials typically accepted by Goodwill include household items, small appliances and clothing. Power driven processing equipment is not used. An attendant works in the donation trailer daily from 9:00 AM - 5:00 PM. Goodwill indicated their willingness to pave around the trailer and to instruct their on-site attendant to keep the trash at the commercial center orderly. n ~J SI,afG There are no current Planning, Building or Code Enforcement violations outstanding at the commercial store. The activity generated by the Goodwill trailer is very limited. The average of three donations per day will not create a significant amount of vehicle traffic. The bollards currently in place around the parcel prohibits vehicles entering the dirt lot. The recycling of the types of materials donated to Goodwill do not generate noise like a bottle or can recycling center would and the operation will operate within the Municipal Code noise standards. RECOMMENDATION: Approval based upon the findings in Resolution No. 4544. Mahoney stated he would have to abstain from this item as he is a volunteer board member of Goodwill Industries. Staff Presentation: Planning Director Cowan presented the staff report noting this is an appeal of the Director's decision to grant a small collection facility permit for Goodwill Industries. He noted the City's ordinance relates to small collection facilities and has a number of pages which detail the design criteria for both the site and landscaping. fie stated staff does support the facility and recommends approval. In response to Com. Ilarris' question, Mr. Cowan stated the lot where the trailer is located is dirt. He believes this will be a relatively light activity and customers will park along the road and drop off materials. Com. Austin asked if this facility will operate on weekends. Mr. Cowan stated the applicant is requesting daily operation, which will be % days a week. Vice Chr. Doyle opened the public hearing. Aaolicant Presentation: Mr. Robert Sasson, Goodwill Industries, gave a brief history of Goodwill Industries and the programs they offer. He stated this facility will not disturb surrounding neighbors. Mr. Sasson added that a full trailer will be removed once a month and replaced with an empty one. He stated the attendant will keep the place clean. tle noted they are losing their site in Monte Vista and the site proposed is a good location. He noted they are in compliance with City codes and believes it will enhance the property. Mr. ©ob Irwin, Appellant, noted he was not aware of this facility until his neighbor informed him. He presented pictures of Goodwill trucks and the site. He stated dust is created when traffic pull in to this parking lot and is concerned about oil spills getting into the water supply. Mr. Irwin noted that all neighbors agree that they do not want approval of this collection facility and this should be reason enough for the Planning Commission to deny the application. e !regarding the recycling of cardboard, Mr. Irwin noted other materials are dropped off at these sites and believes such sites are not maintained. He added the intent of the facility is good, but people abuse the system. Mr. Irwin pointed out that 1.7 miles from the proposed site is a Salvation Army truck. Ite stated if collection centers are needed they should be put in areas were there is no housing. He noted people complain about large motorhomes parked in front of their homes and this truck will be parked 5o ft, from his home. Mr. Irwin addressed property value decline as a result of this collection facility. He addressed the amount of drop-offs per day as addressed by the applicant and believes there will be more than three deliveries a day. He noted in summary, the neighbors do not want this facility and would ask the Planning Commission to deny the application. Mr. lrwin submitted pictures and petitions regarding this facility. Com. Harris addressed a letter from Goodwill dated June 2:1, 1994. Com. Roberts stated that the Goodwill truck may be an improvement to what residents are presently looking at. Mr. Irwin stated he would like this site improved and noise should be kept under control. Ms. U. Vassiliadis, 10128 Camino Vista, stated heavy trucks use A'oothill and Stevens Creek Islvd and this is a dangerous area. She noted any additional traffic will eventually cause an accident. She noted this facility is not needed in this location. Vice Chr. Doyle closed the public hearing. Com. Roberts questioned the size of the trailer? In response to a question from the public, Mr. Cowan stated the parking space will not be limited to Goodwill. Com. fiarris stated she agrees that the access area should be sealed and would agree with a condition to limit the size of the truck. Com. Doyle addressed Mr. Irwin's comments and noted he would have preferred Goodwill to discuss this with the neighbors. He stated he would support the facility with the dust seal and a condition regarding the size of the trailer. MO'1'iON: Com. A small collection facility in this case, is a mobile recycling unit, wlticlt occupies an area of not more than 500 square feet and which accepts donations of recyclable materials from the public. Light proce_ssirg facilities are limited to baling, briquetting, crvshi.ng, compacting grinding, shredding arxi sorting of ems-separated recyclable materials and repairing oP reusable materials sufficient to qualify as a certified processing facility. (b) A heavy processing facility is any processing facility other than a licit processing facility. section 3.3 Reverse Verxiing Machine(s) A Reverse Verrling Machine is an autanated mechanical device which accepts one or more types of empty beverage containers, irroludirg, but not limited to alumi:nan cans, glass and plastic bottles, and issues a cash refund or a redeern~ble credit slip with a value not less than the oontainara rede~tion value, as determined by the State. A reverse vending machine may sort and process containers mechanically provided that the entire Pr's is enclosed within the machine. Section 3.4 Mobile Recycling Centex A mobile Recycling Center means an automobile, truck, trailer or van licensed by the Department oP Motor Vehicles, which is used for the collection of recyclable material. A Mobile Recycling Center also means the bins, boxes or containers transported by trucks, vans, or trailers and used for the collection of recyclable materials. A mobile recycling center may consist of an enclosed Vehicle such as a bcoc cab or enclosed semitrailer or an open vehicle such as a flat bed trailer with bins or boxes to contain recyclable materials. Shall occupy no more than 50 square feet of Floor space per installation, including any protec.~tive enclosure, and shall be not more than eic~t feet in height. 5. Shall be constructed arxi maintained with durable waterproof and rustproof material; 6. Shall be clearly marked to identify the type oP material to be deposited, operating instructions, and the identity and phone number of the operator or responsible person to call iP the machine is inoperative; 7. Shall be no larger than 500 square feet, and occupy no more than five (5) parking spaces not including space that will be periodically needed for removal of materials or excharxJe of containers; 3. Shall be set back at least ten (10) feet frcmm any street line and ~/ ~lection fa~ci~lit~y shall ba sited in a~manner which lbal~ances the need to provide visual accessibility to tha recycling center versus the objective to maintain an attractive street scope for the oammmity. 4. Shall accept only glass bottles, metals, plastic containers, papers and reusable items. Used motor oil may be accepted with permission of the Central Fire District, or other agency which' administers the City's Hazardous Material Ordinances. Used motor oil can only be accepted at an attended sits having containers approved by the administator oP the city's Hazardous Materials Ordinance; 5. Shall use no power driven processing equipment except for bulk reverse verriitg machines: 6. Shall use containers that are constructed and maintained with durable waterproof and rustproof material, covered when site is not attended, secure from unauthorized entry or removal of material and shall be of a capacity sufficient to aooamtadate materials collected and collection schedule; 7.
