Subj: Minor Modification ofwB.U-95 to 1) reduce the height of the south property line
wall from 12 feet to 9 feet and 2) change wall construction to slump block (laid in place)
masonry instead of precast masonry at20558 and 20900 Stevens Creek Boulevard
(Whole Foods Market)
Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of
minor changes to a project. The Director reports his decision to the City Council and
Planning Commission in time to allow any Councilmember or Planning Commissioner to
appeal the decision within fourteen calendar days.
Application:
Minor Modification of 8-U-95 to 1) reduce the height of the south property line wall
from 12 feet to 9 feet and 2) change wall construction to slump block (laid in place)
masonry instead of precast masonry (Exhibit A).
Description:
The applicant, Michael Horton, is proposing to reduce the approved property line wall
height from 12 feet to 9 feet for the proposed wall separating Whole Foods Market from
the adjacent residents. All of the affected homeowners have agreed to the wall height
reduction in writing (Exhibit B) and the noise consultant has concluded that the wall
height change will have an insignificant effect on noise (Exhibit C).
In addition, the applicant is proposing to change the type of construction from precast
masonry to slump block (laid in place) masonry because the trees and overhead utility
lines prevent precast wall panels to be lifted into place.
Action:
The Director of Community Development deems the modification minor and approves
the wall height reduction and chance in wall construction.
This approval of the modification is effective December 5, 1995. The fourteen calendar
day appeal period will expire on December 19, 1995.
