G • ^r ^ Wilson A Portal Parks Gentlemen: Enclosed please rind five (5) copies each of our Progress Billing #5 with reference to Wilson and Portal Parks, dated June 30, 1969, and which re- presents one hundred percent completion of all work on this project. We notified your office in writing on June 19, 1969, that our work was completed and ready for final inspection and acceptance. We have since been informed by your office, that legal acceptance of this project cannot be consumated until July 8, 1969, and that same has to be approved by the City Council of the City of Cupertino. We were delayed a week or ten days in placing the asphalt paving on the walks on both projects, due to excess accumulation of water in these areas from the lawn sprinkler system. In summary, these buildings were substantially complete and ready for acceptance approximately a week or ten days prior to June 19, with the exception of the paving and delay as mentioned above. Furthermore, we have been faced with continuous vandalism necessitating repairs on both of these buildings for the past four to six weeks. The cost has become unbearable for a project of this size. We have notified the agencies involved in this matter and even requested assistance in obtaining police protection, with apparently little or no results. Therefore, we strongly urge you to accept the buildings and start operating same so as to avoid further damage through vandalism. Should there be any items that need correction due to vandalism or otherwise, we will endeavor to take care of same after final inspection and acceptance of the buildings. We are hoping for your full cooperation in this matter, in order to complete this job without showing a loss to our company. We would also like to re- quest at this time that a Notice of Completion be filed as soon as possible. Very truly yours, JOSEPH J. TAYLOR 8 ASSOCIATES, INC. , JJT'cg Encl . Robert Dempster Mayor of the City of Cupertino and Members of the Cupertino City Council 103M Torre Avenue Cupertino, California 95014 Gentlemen: Air. William Benevich and I conducted a Final Inspection this day of the two Parks Buildings in Wilson Park and Portal Park. We found these structures, in general, to be complete and in compliance with Y the plans and specifications as approved by your council. I am submitting with this letter a check list of those items which require additional attention by the general contractor. These items are of a minor nature, and the contractor should be instructed that these items are to be completed prior to the release of the final 10 per cent of his payment. The City has a one year guarantee on both structures and equipment so that if any difficulties develop during this period the correction of such difficulties would still remain the responsibility of the ► general contractor. It is my recommendation that your council formally accept these buildings for the City of Cupertino and direct the appropriate person to file a Notice of Completion on both structures. I would like to take this opportunity to express my appreciation to you for the opportunity of serving as Architect for these two projects, and hope that the Citizens of Cupertino will find these buildings to be an asset to their community, both functionally, and aestetically.
