AGREEMENT,CERTIFICATE OF COMPLETION 12/19/68 Page 1 A G R E E M E N T THIS AGREEM ENT, made this 19th day of Dec. 1968 by and between the City of Cupertino, a municipal corporation of the State of California, hereinafter called the City, and Joseph J. Taylor & Associates, Inc. , hereinafter called the Contractor W i T N E S S E T H: WHEREAS, the Council of the City of Cupertino did, on the 16th day of December , 19 68 , find that the Contractor was the lowest responsible bidder for said project, and did award the Contractor a contract for said project; NOW THEREFORE, for and in consideration of their mutual promises, covenants, undertakings and agreements, the parties hereto do hereby agree as foll.,ws: 1. Contractor agrees to do all the work, and furnish all the labor, materials, equipment, and other property, and do all other things required of him by the hereinafter mentioned Contract Documents, for the following project, to wit: Comnunity Center Buildings at Wilson Park and Portal Park ® including bosh alternates 2. The Contract Documents herein mentioned consist of the proposal and the "Specifications for Community Center �1dgs. et al, Cupertino, California" which includes but not by way of limitation, the Notice to Bidders, the General Conditions, this Agreement, the Faithful Performance Bond, the Labor and Materials Bond, insurance requirements, the General and Special Conditions, and all other dor—rents and papers included or therein referred to and made part thereof, on file in the office of the City Clerk, City Hall, 10300 Torre Avenue, Cupertino, California, together with all plans and drawings for Com.Ctr.Bldgs. ,etal , for said City rPFerred to in said specifications and on file in said office of said City Clerk, together with any and all addends to any of the above, all of which documents are incorporated herein and made a part hereof by reference. 3 City agrees to pay to Contractor, and Contractor egrees to accept in full payment of all things required to be done by Contractoz as outlined in said Contract Documents, and in full payment, of all promises, covenants, obligations, under- takings and liabilities made, done or assumed by the Contractor, the following total sum, to wit: FLF=-aL T.EQUSAND SIXTY-EIGHT DOLLARS ($ 5 p68.Qu ), at the time and in the manner and as provided for and subject to and in accordance with all previsions of said Contract Documents and all applicable provisions of law.
