The Board of Supervisors at its regularly scheduled meeting on February 7, 1966 approved this agreement on behalf of the County. The enclosed copy is for your records. MLNRK[N•.ATn DISTw+cT SAM P.DELLA MAGGIOR6,1NO 014TAICT MARTIN J,•PANGLSM,%T-O+sTRICT CNARL&O A.OUMN,3Aa Qt•TAICT J"N PULLAN.CLEAR OF TPIE•OARD City & County - Street acjl ting SSE` FOR STREET LIMN 4 IN N*MY ANNMM TERRLTORY THIS IS AN AGMEMENT between the City of , hereinafter referred to as City, and the County of :'anta Clara, hereinafter referred to as County. t' WIMEA.S, County provides street lighting of certain unin- corporated areas through the County Lighting Service Area; and SAS, City will from time to time annex portions of the unincorporated territory included with-In the County Lighting Service iltrea which has the effect of automatically excluding the territory from the County Lighting Service Area; and z WHERE-AS, Government Code Section 25210.90 provides that upon the exclusion of such territory all unencumbered funds standing to the credit of the area upon the date of the exclu- sion shall be divided between the city and the county service area in proportion to the assessed value of the real property of the territory excluded and the portion remaining; and WHEREAS, Goverment Code Sections 35318.1 and 35146. 1 provides that as an alternative to the division of taxes or assessments collected upon exclusion of district territory from a city, city and county may agree that a special district may continue to perform services for such annexed territory until the close of the fiscal year for which the special dis- trict has levied taxes; and WHEREAS , the adoption of such procedure would be fair to both parties and greatly simplify accounting procedures; NOW, THEREFORE, County and City agree as follows: 1., County agrees to continue to provide at County expense street lighting to terz- tort' included in the County d� _ MP i Lighting Service Area and annexed to City until the close of the fiscal year for which the County Lighting Service Area has levied taxes. 2. City agrees to waive the payments from County provided under Covet Code Section 25210.90. 3. This agreement may be terminated by either party on June 30th of any year provided that written notice of such termination has been given at least thirty (30) days prior to the end of the fiscal year.
