Gentlemen:
The City of San Jose hereby acknowledges receipt of the executed agree-
ment prepared and subwitted by you concerning the storm drainage and future
City boundaries in the McLellan Road - Regnart Creek drainage area,
The agreement has been review by the Cityss legal staff. Because the
agreement has two, essentially unrelated objectives, namely boundaries and
storm drainage, the Cityls Legal Department has recommended that two separate
agreements be caployed rather than one combined document. We are now in the
process of writing two distinct and separate documents, one covering each of
the above mentioned subjects.
0n January 2.Oth of this year we submitted plans and specifications for
a portion of the storm sewer construction, Hwy 9 to 6009 b of Stelling, with
a request for an encroachment permit to Mr. Fleming, City of Cupertino, City
]kgineer. In the letter of transmittal we stated our willingness to finance
this project in its entirety prior :o final drafting of the much discussed
mutual sharing agreement. We feel that the people who live in the affected
area have lived with a highly undesireab].,, situation considerably longer than
should be expected in any modern city, whether it be Cupertino or San Jose.
In order to prevent any future flooding and to eliminate the continual
health hazard in this area the City of San Jose respectfully requests an
encroachment permit for the installation of the McLellan Road stormy sewer
trunkline,

Dear Mr. Storm:
It our meeting on June 15, 1961 concerning the construction of the McClellan &wad-
Restart Creek joint stow sewer trwdc iAe, we agreed to submit a letter to your office
in regard to your City'a request for construction credits for improvements on Regnart
Creek.
City of Sant Jose is reluctant to include construction credits for creels improve-
ments in the McClellan Road storm sewer agreement.
The normal recourse for reimbursement for improvement s of flood control facilities
would naturally be the County Flood Control District,
Flood Control District has requested or required developers in San Jose to dedicate
rights-of-way, similar to the one in question, with no reimbursement whatsoever. The
Flood Control District also has condemned and purchased rights-of-4ay using zone tax
monies. We feel zone tax monies should have been used for reimbursement to your City in
this case,
however; because the Flood Control District disclaims any responsibility for reim-
bursement to your City, we feel that. Cupertino may have incurred some costs that would
not have been Cupertinots alone had the Flood Control District followed its usual method
of procedure.
Therefore, the City of San Jose may be agreeable to allowing Cupertino certain
credits with the understanding that San Jose is sharing only in costs that would not
necessarily be Cupertino's alone.
We have determined the Regnart Creek watershed to contain 1757 ac. There are 380
ac. within the McClellan Road storm drainage areas or 21.6% of the total watershed. This
21.6% of the requested creek improvement costs ($42,,263.80) could then be reasonably
charged to the McClellan Road storm sewer ($9,133.30). San Jose has at present 49% of
the area in the McClellan Road storm drainage Brea. This percentage within San Jose would
give Cupertino a #4#475.32 credit towards the trunk line construction described in the
proposed agreement.
If this is agreeable to your City please notify us and we will proceed with the
inclusion of these credits in the proposed agreement.

This is in refer_nce to the proposed joint City of Cupertino-City of
San Jose McClellan Road-Regnart Creek Storm Seaver Trunkline.
As far as we know, all differences regarding the proposed trunk-line
have been resolved with Mark Thomas & Co., Engineers for tte City of
Cupertino involving such items as design, revised engineer's estimate,
credit for Regnart Creek Improv,,ments, developed land acreages,
proportionate sharing of drainage area, etc. r_1
Mr. George Perkins of Mark Thomas & Co. has agreed to handle the design
of the system across State Highway 9 and thence northeasterly to Regnart
Creek in time to meet the schedule of the proposed widening of State_----'
Highway 9.We are wondering what is causing the delay in bringing this project to
a conclusion. Copies of the agreement had been sent to Mr. Storm which
are ready for execution.
Please let us know if there is any other information you may need.
