The permit may be granted by the Director without a requirement for a public hearing. The Director reports his decision tot he City Council and Planning Commission in time to allow any Councilmember or Planning Commissioner to appeal the decision within fourteen calendaz days. Application Use permit for the operation of an Attended Donation Station and Recycling Center at 20850 Stevens Creek Boulevard, Cupertino. Description Goodwill Industries of Santa Clara seeks a permit for the operation of an Attended Donation Station and Recycling Center. A 27 foot mobile trailer will be used for the collection of clothing, toys and small appliances. The hours of operation will be between 9 a.m. to 5 p.m. daily. A full trailer will be removed once month and replaced with an empty one. The Director approved the request for a temporary use permit on June O1, 1995. The applicant had provided three alternate parking stalls on the site for the parking of the trailer. The pazking space that was approved was located at the reaz of the parking lot facing the street. The Applicant feels that the approved location is not visible from the street, and would like to get an approval to use the pazking space that faces Stevens Creek Boulevard. (See enclosed site plan) Action "fhe request has been approved for a temporary use permit with the following conditions: I . A full trailer will be removed once a month and replaced with an empty one. Normally, such a request would be considered under Ordinance 1426, Section 6.2 -Small Collection Facilities. The proposed Collection Facility complies wfth all of the conditions stated in this ordinance with respect to the number of parking spaces that can be occupied, hours of operation, setback requirements and distance from residential areas. But the one condition that is not met is that the facility be established in conjunction with an existing commercial, office, industrial or communfty service facility. A strict interpretation of this clause would mean that the proposed facility be set up with an existing "operating" service/ collection facility. Since this is not complied with on this site, the proposal is considered under Chapter 19.128 -Conditional use permit for temporary uses. ~II The request has been approved for a temporary use permit with the following conditions: 1. The location indicated in the site plan enclosed, may be used for the parkingof the trailer for collection facilities. 2. The hours of operation will be 9 a.m. to 5 p.m. daily. 3. The temporary use pennft is valid from June 15,1995 and expires on December 15, 1995. 3. Ii a change of use occurs on the parcel, a new permit by Goodwill Industries must be applied for and approved. 4.
