Sub: Report of Director's Decisbn Regarding Temporary Use Permit
Chapter 19.128 of the Cupertino Municipal Code states that the Director of Community Devebpment may grant a
conditional use permit authorizing the use of a site in any zoning district for a temporary use not exceeding six
months. The permit may be granted by the Director without a requirement for a public hearing. The Director
reports his decision to the City Council and Planning Commission in time to allow any Council member or
Planning Commissioner to appeal the decision within fourteen calendar days.

Use pemut for the operaton of an Attended Donat'an Station and Recycling Center at 20850 Stevens Creek
Boulevard, Cupertino. (See encbsed Site Plan).

Goodwill Industries of Santa Clara seeks a permit for the operation of an Ariended Donation Station and
Recycling Center. A 27 feet mobile trailer will be used for the collection of clothing, toys and small appliances.
The hours of operation will be between 9 a.m. to 5 p.m. daily. A full trailer will be removed once a month and
replaced with an empty one.
Normally, such a request would be considered under Ordinance 1426, Section 6.2 -Small Collection Facilities
The proposed Collection Faciifty complies with all of the conditions stated in this ordinance wRh respect to the
number of parking spaces that can be occupied, hours of operaton, setback requirements and distance from
residential areas.
But the one condition that is not met is that the facility be established in conjunction with an existing commercial,
office, industrial or community service facility. A strict interpretation of this clause would mean that the proposed
facility be set up with an existing 'operating" service/ collection facility. Since this is not complied with on this sfte,
the proposal is considered under Chapter 19.128 -Conditional use permit for temporary uses.

The request has been approved for a temporary use permit with the folbwing condifwns:
1. The bCation indicated in the site plan encbsed, may be used for the parking of the trailer for collection facilities.
2. The hours of operaton will be 9 a.m. to 5 p.m. daily.
3. The temporary use permft is valid from June 16,1995 and expires on December 16, 1995.
3. If a change of use occurs on the parcel, a new permit by Goodwill Industries must be applied for and approved.
4. All provisions of Ordinance No. 1426, Section 6.2 (Small Collection Facility) ,except subsection 1, must be
adhered to.

This is to acknowledge that a Goodwill of Santa Clara County Attended Donation
Station has been given permission to operate on our premises.
Goodwill agrees to keep the area around the Donation Station clean and free of
unsolicited materials.
We have the right to ask Goodwill to remove its Donation Station at any time
with a 24-hour notice.
The funds earned through the sale of items donated at our Attended Donation
Stations provide vocational evaluation, training, rehabilitation and job
placement for disabled and disadvantaged people in the o uni
