DIR-1996-21bCITY OFCUPERTINO ~),j )~' -~;~~il~, ///1~ 10300'forre Avenue, Cupertino, California 95014 (408) 777-3308 ~l • To: Mayor and City Councilmcmbers Chairman and Planning Commissioners From: Robert Cowan, Director of Community Development Date: November 27, 1996 Subj: Report of Director's Decision Regarding a Minor Modification Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow any Councilmember or Planning Commissioner to appeal the decision within fourteen calendar days. ~jlnlication Application No.: 7-U-81 (Mod.), Symantec, Inc., 10201 Torre Avenue. Descri tp ion Symantec proposes to locate an emergency generator on an existing concrete pad which is in the northeast area of the property, 12'3" from the north property line (see attached site plan, Exhibit A). The generator would be used for emergencies, and would be tested once every two weeks for IS minutes and every six months for two Hours. Noise and visual impacts are the issues. • Discussion Noise: The enclosed acoustical report indicates that with mitigations, the noise level from the generator will not exceed 50 dBA at the proposed adjacent apartment buildings in City Center, which is the maximum nighttime standard. The balconies of the apartments are approximately 30 feet from the generator. Mitigation consists of a 12 ft. noise barrier enclosure (see Exhibit B), made of overlapping redwood (Exhibit C), as well as an exhaust reduction system. Visual Impacts: The enclosure will be visible from the adjacent apartments. There are low shrubs currently between the proposed generator site and the apartments. There are several trees in the area, but are widely spaced apart. The new apartments also will have low shrubs on their south property line, which probably will not interrupt the view behveen the apartments and the generator/enclosure. The redwood materials will give the enclosure afence-like appearance, but the height will be imposing. A condition of approval requires an additional new tree and replacing a dead tree to provide additional screening. in The Director approves the modification with the following conditions: I . "felting shall be during daytime hours. 2. An additional tree and a replacement trce for the nearby dead tree shall be planted within 30 days of approval. faulosures: Exhibit A -Site Plan L'•xhibit B -Generator/Enclosure Site Plan • Exhibit C =Noise Barrier Section Acoustical Report gpJrcryrtt/7u8l nt
