Subj: Report of Director's Decision Regarding a Minor Modification
Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of
minor changes in a project. The Director reports his decision to the City Council and
Planning Commission in time to allow any Councilmember or Planning Commissioner
to appeal the decision within fourteen calendaz days.
Application 8-U-94(NI).Citation Homes Central has requested a minor modification to the
• conditional use permit granted on a 140-unit apartment complex located at the southeast comer
of Homestead Road and De Anza Boulevazd.
As described in the attached Citation Homes description, the request is to modify one of two
baloncies on the unit "A" apartments by reducing the depth of the balcony by 1'. There aze 28
apartment "A's" site-wide. The current dimensions of the deck, are 7' wide by 5' deep. The
resulting deck size would be 7' wide by 4' deep. The purpose of the change is to increase the
functional area of the dining room. The resulting deck would continue to be functional. The
reduction in depth results in the relocation of the water heater to the other deck which displaces
storage. The storage will be relocated to cabinets in the gazage.
The Director approves the minor modification.

• SUMMARY OF REQUEST
In an effort to increase the width of the Unit A dining room, which we feel will
significantly add to the usability and improved ambiance of the interior living
space of that unit, we are requesting the Planning Director's approval for a minor
modification.
There are four (4) "A" units per building and a total of seven (7) buildings
sitewide. The "A" units are located on the second and third floors of each
building and are visible from the front and side elevations. Each "A" unit was
approved with two (2) exterior decks. The larger deck (approximately 60 sq. ft.)
is located off of the bedroom, while the smaller deck (approximately 35 sq. ft.) is
located off of the dining room. The dining room deck's measurement is roughly
7 feet wide by 5 feet deep.
• We are requesting to reduce the dining room deck depth by one (1) foot which
will result in a loss of deck space of seven (7) sq. ft. and a corresponding
increase in living area of that same amount. The modified deck dimension, if
approved, would be approximately 7 feet wide by 4 feet deep which we feel still
provides functionality and usability for the tenant.
As part of.this modification, we would relocate the water heater from the dining
room deck over to the bedroom deck. The storage area which had been
approved for the bedroom deck will now be provided inside the enclosed
garages via our implementation of storage cabinets.
I am attaching floorplans and elevations which depict Unit A as it was originally
approved and as it would be if our modification request is allowed.
