Subj: Report of Director's Decision Regarding a Minor Modification
Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor
changes in a project. The Director reports his decision to the City Council and Planning Commission
in time to allow any Councilmember or Planning Commissioner to appeal the decision within
fourteen calendar days.

Application 16-U-86 (M). To expand by 80 sq. ft. an existing restaurant (formerly Hamburger
Hamlet) with a projecting window feature for the purposes of displaying food products.
This 9,460 square foot restaurant space is allowed 260 seats. The applicant proposes to occupy the
space with an upscale version of the Harry's Hofbrau currently operating in the City of San Jose,
located on Homestead Road and Saratoga Avenue. The classic window display for this restaurant is a
rotisserie displaying turkey, chicken or beef The new window placement will result in a reduction of
80 square feet of landscaping but 2 feet of landscape depth will remain in front of the window. The
window pattern, wood siding and canopy color will match the existing building materials.
Recommendation
The Director of Community Development approves the expansion, as shown in the Daymo plan dated
9/20/96. The condition of approval is:
1) The 80 square feet shall never be used for the expansion of floor area for other than displaying
products for sale within the restaurant.

To Whom It May Concern:
I have been the leasing agent for the Marketplace on Stevens Creek for the past 2 '/z years. Last
summer we were notified that the freestanding Hamburger Hamlet restaurant building located
within the center was available for sale through CB Commercial Real Estate Company. In early
November, 1995, the Hamburger Hamlet Chain declared Chapter I 1 bankruptcy. The Cupertino
location was closed on November 22, 1995, at that point the owners of the shopping center
regained control of the building. I was authorized to start marketing the property to prospective
new tenants.
